Chap. 302.—An ACT to amend and re-enact an act entitled “an act requiring assis
tants and officers appointed by the motor vehicle commissioner and engage
in the enforcement of the laws concerning the operation of motor vehicles t
give bond for the lawful and faithful discharge of their duties”, approved Marcl
29, 1926, so as to permit police officers appointed by the Director of the Divisio:
of Motor Vehicles to furnish a liability insurance policy as proof of their ability
to respond in damages to any action maintained against them for damages anc
injuries to others, resulting from their unlawful, negligent and improper conduc
in the performance of their official duties. [H B 446

1. Be it enacted by the General Assembly of Virginia, That an
act entitled “‘an act requiring assistants and officers appointed by
he motor vehicle commissioner and engaged in the enforcement of
he laws concerning the operation of motor vehicles to give bond for
he lawful and faithful discharge of their duties”, approved March
wenty-ninth, nineteen hundred and twenty-six, be amended and re-
nacted so as to read as follows:
That all police officers appointed by the Director of the Division
f Motor Vehicles, and engaged in the enforcement of criminal laws
ind the laws relating to the operation of motor vehicles upon the
oads and highways of this State, shall, before entering upon or con-
inuing in their duties, enter into bond, with some solvent guaranty
ompany authorized to do business in this State, as surety, in the
enalty of two thousand dollars, and with condition for the faithful
nd lawful performance of their duties. Such bonds shall be filed
1 the office of the Division of Motor Vehicles, and the premiums
hereon shall be paid out of the fund appropriated for the enforce-
1ent of the laws concerning motor vehicles. All persons injured or
amaged in any manner by the unlawful, negligent or improper con-
uct of any such officer while on duty may maintain an action upon
uch bond.
In lieu of posting bond as provided herein, any such police officer
1ay furnish an adequate liability insurance policy as proof of his
bility to respond in damages, which may be adjudged against him
1 favor of any person or persons injured or damaced in anv manner
sulting from his unlawful, negligent or improper co1duct woue on
facial duty, to the amount of two thousand dollars. The premiums
n any such insurance policy or policies shall be paid cut of the funds
ppropriated for the enforcement of the laws corcerning motor
ehicles.
All such bonds and insurance policies shall be approved by the
irector.
