Chap. 301.—An ACT to amend and re-enact sections 306 and 307 of the Code of
Virginia, as heretofore amended, relating to the duties of the Clerk of the House
of Delegates. [H B 436]

1. Be it enacted by the General Assembly of Virginia, That
sections three hundred and six and three hundred and seven of the
Code of Virginia, as heretofore amended, be amended and re-enacted
so as to read as follows:
Section 306. Duties of Clerk of House of Delegates.—In addition
to such duties as may be prescribed by the rules of the House, the
Clerk of the House of Delegates shall at the end of each session of
the General Assembly, prepare a well-arranged index to the journal
of the House and the documents printed during the session by order
of the House. He shall cause to be printed, with the acts and such
joint resolutions as are not of a purely procedural nature of each
session of the General Assembly, tables showing the time for the com-
mencement of the regular terms of the Supreme Court of Appeals and
of each circuit, corporation, and city court; the places at which
separate polls have been established in each county; the names of
the several magisterial districts in each county; and the names or
numbers of the several wards, or precincts if there be no wards, in
each city; a list of the commissioners in other States, appointed by
the Governor; and a carefully prepared and well-arranged index of
the acts and joint resolutions.
The Clerk of the House of Delegates shall cause to be published
for the time prescribed by the Constitution, all proposed amend-
ments to the Constitution. Such publications shall be done as fol-
lows: He shall have printed one thousand copies for distribution from
his office and a sufficient number additional of all such proposed
amendments to enable him to forward to the clerk of every circuit
and corporation or hustings court in this State five hundred copies
of the same, which forwarding he shall do not later shan one month
prior to the time for the commencement of the publication required
by the Constitution. Every such clerk of court shall, upon the receipt
of such copies, post ten of such copies at the front door of his court-
house, and shall deliver to the sheriff of his county o:° the sergeant of
his city a sufficient number of such copies to enabl2 such sheriff or
sergeant to post ten of such copies at each voting plz.ce in his county
or city and in five other conspicuous places in his county or city,
and such sheriff or sergeant shall do such posting. The remainder of
such copies shall be exposed in the office of such clerk for free distri-
bution among such citizens as may apply for copies. Every such
clerk of court, and every such sheriff or sergeant, shall complete the
posting hereby required not later than three months prior to the
next ensuing general election of members of the Hcuse of Delegates
and shall make return thereof to the Clerk of the House of Delegates
upon the completion of such posting. Every such sheriff or sergeant,
for the services rendered by him under this section, shall receive ten
cents for each copy which he is required by this a:t to post, which
compensation shall be paid him out of the State treasury on warrant
of the Comptroller issued on a voucher signed by the Clerk of the
House of Delegates that proper return has been made by such sheriff
or sergeant that such posting has been done. The compliance by the
Clerk of the House of Delegates with the foregoing provisions of this
paragraph shall be conclusive evidence that such proposed amend-
ment or amendments to the Constitution have been published as
required by the Constitution. The Clerk of the House of Delegates
shall also cause to be published monthly for three consecutive months
in one daily newspaper published in the city of Richmond, all pro-
posed amendments to the Constitution, the first publication to be
made at the time fixed by the Constitution for the commencement of
the publication of all proposed amendments to the Constitution.
All costs, the payment of which is not hereinatove provided for,
shall be certified by the Clerk of the House of Delesrates to the Comp-
troller for payment. The Clerk of the Howse of Delegates shall make
report of the action taken by him under this paragraph to the next
succeeding General Assembly.
Section 307. Clerk to be Keeper of the Rolls..—The Clerk of the
House of Delegates shall be the Keeper of the Rol's of the State. As
such, he shall cause all of the acts of the General .Assembly and joint
resolutions proposing amendments to the Constitution, to be enrolled
on substantial paper, of uniform size, either by the use of pen and ink,
typewriter, printing or lithographing, either or all, or by such other
permanent and substantial method or methods as he may deem proper;
and after they shall have been examined by the committees on en-
rolled bills, and signed by the President of the Senate and Speaker
of the House of Delegates, he shall cause the same to be bound in
durable style. He shall have the custody of the icts and resolutions
of the General Assembly, and the records and papers of the House of
Delegates; and, when required, shall furnish a ccpy of any of them;
which copy, being certified by him shall be evidence for any purpose
for which the original would be received, and with as much effec
He shall, as soon as practicable after every act is passed, prepare th
same for publication, and furnish to the Director of the Division
Purchase and Printing the manuscript of all acts of the Gener
Assembly and joint resolutions proposing amendments to the Cor
stitution, and such other joint resolutions as are not of a purely prc
cedural nature, or copy thereof, properly arranged for being printec
And he shall, as soon as practicable after the adjournment of th
General Assembly, furnish the index and the tables required by law
and shall superintend the publication of such acts, resolutions, table
and index, in connection with the Director of the Division of Purchas
and Printing.
