Chap. 294.—An ACT to appropriate the sum of $5,000.00, or so much thereof as may
be necessary, to be used by the Virginia Conservation Commission in connection
with the proposed establishment by the United States in Tennessee, Kentucky
and Virginia of the ‘‘Cumberland Gap National Historical Park’’, and to confer
upon the said commission certain powers in connection with such proposed
park. [H B 356]

1. Be it enacted by the General Assembly of Virginia, That
there is hereby appropriated to the Virginia Conservation Commis-
sion, out of any funds in the State treasury not otherwise appropriated,
the sum of five thousand dollars, or so much thereof as may be nec-
essary for the purpose, to be used by the said Commission in pro-
moting and furthering the establishment by the United States of
America of a public park in the Cumberland Gap-Cumberland Ford
areas of Tennessee, Kentucky and Virginia, to be known as the
“Cumberland Gap National Historical Park’’, and in making surveys
of and acquiring options on lands in the proposed park area. The
said Commission is hereby authorized and empowered to cooperate
with any appropriate officers or agencies of the States of Tennessee
and Kentucky, and with the National Park Service of the Depart-
ment of the Interior of the United States, in bringing about the es-
tablishment and development of the proposed national historical
park.
Provided, however, that the funds herein provided shall not be
available unless and until the said Cumberland Gap National His-
torical Park is authorized to be established by the Congress of the
United States. It is provided, however, that such appropriation shall
not be available for expenditure, either in whole or in part, unless and
until the Governor has certified to the Comptroller in writing that
the payment of the said appropriation will not, in the judgment of
the Governor, create or add to a deficit in the general fund of the
State treasury, during the biennium which ends June 30, 1942.
