continue an old road where a new road has been or is constructed to take its

1. Be it enacted by the General Assembly of Virginia, That
when any road has been or is altered and a new road, which serves
the same citizens as the old road, is constructed in lieu thereof and
approved by the State Highway Commissioner, the old road may be
discontinued to the extent of such alteration, but no further, by a
resolution of the board of supervisors of the county, declaring the
old road abandoned and discontinued to the extent of such alteration;
provided, however, that this act shall in no way affect the statutory
procedure for discontinuing a road where no new road is constructed
to take its place.
