Chap. 227.—An ACT to amend and re-enact Section 298 of the Code of Virginia, as
heretofore amended, relating to continuance of cases where an officer or a
member of the. General Assembly is a party to such case, or attorney for a
party thereto. [S B 233]

1. Be it enacted by the General Assembly of Virginia, That
section two hundred and ninety-eight of the Code of Virginia, as
heretofore amended, be amended and re-enacted so as to read as
follows:
Section 298. Any party to an action or proceeding in any court,
commission or other tribunal having judicial or quasi judicial powers
or jurisdiction, who is an officer or member of the General Assembly,
or who has, prior to or during the session of the General Assembly,
employed or retained to represent him in such action or proceeding
an attorney who is an officer or member of the General Assembly,
shall be entitled to a continuance as a matter of right during the
period beginning fifteen days prior to the commencement of the said
session and ending thirty days after the adjournment thereof; and
the failure of any court, commission or other tribunal to allow such
continuance when requested so to do shall constitute reversible error.
2. An emergency existing, this act shall be in force from its
passage.
