Chap. 175.—An ACT to make it lawful to gig red-horse, carp, and other non-game
fish in the waters of Clinch River, within the County of Russell, during certain
periods; to prescribe the bag limit for such fish; to provide penalties for viola-
tions; to authorize the board of supervisors of said county to pay rewards to
persons furnishing information which leads to the conviction of any person for
dynamiting fish in any stream in said county; to provide that the Commission
of Game and Inland Fisheries shall not discriminate against Clinch River, in
said county, in the matter of restocking inland waters with game fish, on account
of any provisions of this act; and to repeal an act entitled “‘An act to authorize
the Chairman of the Commission of Game and Inland Fisheries, to issue per-
mits to gig certain kinds of fish in Clinch River, within Russell County, during
certain periods and upon certain conditions.”’, approved February 24, 1938.

1. Beit enacted by the General Assembly of Virginia as follows:
Section 1. It shall be lawful for any person having a current
license to fish in Russell County, to take by means of a gig, or gigs,
red-horse, carp or any other fish not classed as game fish, from the
waters of Clinch River, within the limits of said county, during day-
light hours, during the months of October, November and December
of any year, provided that the bag limit for such non-game fish, during
any such open season shall be an aggregate of twenty in any one day
and two hundred in any one season.
Section 2. Any person violating any provision of the preceding
section shall be guilty of a misdemeanor and upon conviction thereof,
shall be fined not less than five dollars nor more than fifty dollars for
each offense.
Section 3. The board of supervisors of Russell County shall have
authority to offer and pay a reward, not in excess of fifty dollars, to
any person furnishing information which leads to the conviction of any
person for dynamiting fish in any stream in said county.
Section 4. The Commission of Game and Inland Fisheries shall
not discriminate against Clinch River, in the county of Russell, in the
exercise of its powers and duties in the matter of restocking the inland
waters with game fish, on account of the provisions of section one of
this act.
2. Be it further enacted by the General Assembly of Virginia,
That an act entitled ‘An act to authorize the chairman of the Com-
mission of Game and Inland Fisheries, to issue permits to gig certain
kind of fish in Clinch River, within Russell County, during certain
periods and upon certain conditions.’’, approved February twenty-
fourth, nineteen hundred and thirty-eight, be, and the same is hereby
repealed. ,
3. An emergency existing, this act shall be in force from its
passage.
