Chap. 155.—An ACT to amend the Code of Virginia by adding thereto a new section
numbered 5202-a prescribing how valid liens may be obtained on certain live-
stock and poultry, providing for the method of filing and docketing such liens,
and validating certain mortgages, chattel mortgages and deeds of trust, here-
tofore executed, embracing livestock and poultry, or either. [H B 273]

1. Beit enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding thereto a new section numbered
fifty-two hundred and two-a, which new section shall read as follows:
Section 5202-a. Every mortgage, chattel mortgage or deed of
trust, heretofore or hereafter executed, embracing livestock or poultry
owned by any person, firm, association or corporation and kept or
held for the purpose of raising, feeding, fattening, or otherwise pre-
paring or conditioning for sale or resale, or which is kept or held for
use, shall be a valid encumbrance upon such property as to purchasers
for valuable consideration without notice and creditors from the time
it is filed for docketing in the office of the clerk of the court of the
county or city where deeds are admitted to record, as provided by law,
in which the property is located at the time of the execution of such
instrument.
When any such instrument is presented to the clerk he shall endorse
thereon the words ‘‘filed and docketed’’, together with the day and
hour of such filing, with his signature affixed thereto, and shall docket
such instrument in the miscellaneous lien book in his office by setting
out the date of the instrument, the name of the parties thereto, the
amount secured thereby, and a brief description of the property em-
braced therein and the premises on which said property is located.
The clerk shall index such instrument in the names of the parties
thereto in the daily index and in the general index of his office, and
shall receive a fee of one dollar for such filing, docketing and indexing.
2. An emergency existing, this act shall be in force from its
passage.
