Chap. 108.—An ACT to authorize the State Hospital Board to convey to J. A.
Overbay all the right, title and interest of the Southwestern State Hospital and
the Commonwealth of Virginia in and to two certain tracts of land near Marion
in Smyth County, and to use the money received from such sale i in the purchase
of certain other lands in said county. 7 (H B 181]

1. Beit enacted by the General Assembly of Virginia as follows:
Section 1. Whenever J. A. Overbay and Grace Overbay, his
wife, shall tender to the State Hospital Board a good and sufficient
deed, accompanied by abstracts or other evidence of title thereto,
approved by the Attorney General conveying to the Southwestern
State Hospital for the benefit of the Commonwealth of Virginia, a
certain tract or parcel of land situated on Hook’s Branch, south of
and near the town of Marion in Smyth County, Virginia, and ad-
joining the lands of the said Southwestern State Hospital on the
east, south and west, containing nine and one-half acres, more or
less, and being a part of the Overbay tract of land, the said State
Hospital Board be, and it is hereby, authorized and empowered, for a
consideration of one thousand dollars and upon such conditions as
it may deem proper, to convey to the said J. A. Overbay, by proper
deed or deeds signed and executed by such person or persons as shall
be authorized and designated by the said Board for the purpose, all
right, title and interest of the Southwestern State Hospital and of
the Commonwealth of Virginia in and to two certain tracts of land
situated south of and near the town of Marion in Smyth County,
Virginia, and more particularly described as follows:
Tract No. 1: Beginning at a point in the center line of Parson’s
Road, which point is in the middle of the stream known as Staley’s
Creek, thence S. 00° 25’ E. 300 feet along the center of Parson’s
Road to a point, thence N. 31° 05’ W. 312 feet to a point where
Hook’s Branch flows into Staley’s Creek, thence N. 84° 30’ E. 115
feet to the point of beginning, containing four-tenths of an acre, more
or less; all as shown on a plat of survey thereof made November
nineteen hundred and thirty-nine, by Walter L. Grollehon, C. S.,
and entitled ‘Map of a Lot at Marion, Virginia, belonging to the
Southwestern Hospital, purchased from Anna Belle Buchanan’”’.
Tract No. 2: Beginning at a point in the northeast line of the
present Staley’s Creek Road, which point is at the northwest corner
of the Leedy lot, thence N. 38° E. 75 feet to a point in the southwest
line of the right of way for a new proposed highway as shown on a
revised plat of survey thereof, thence N. 78° W. 74 feet along the
said right of way to a point at the beginning of a curve, thence along
said right of way with a 10° curve to the right 146 feet to a point
where the southwest line of said right of way intersects the northeast
line of the said Staley’s Creek Road, thence S. 48° E. 212 feet along
the northeast line of Staley’s Creek Road to the point of beginning,
containing one-quarter acre, more or less; all as shown on a plat of
survey made November, nineteen hundred and thirty-nine, by Walter
L. Grollehon, C. S. and entitled ‘‘Map of Roads at Marion, Virginia,
for Hospital’’. |
Section 2. All money received from the sale of such property
shall be paid into the State treasury to the credit of the State Hospital
Board, and is hereby appropriated to the said Board, and the said
Board is hereby authorized to use the same in the purchase from J. A.
Overbay and wife of the nine and one-half acre tract on Hook's
Branch referred to in this act. All money hereby appropriated shall
be expended upon warrants of the Comptroller issued upon vouchers
signed by the Chairman of the said Board, or such other person or
persons as may be designated by the said Board for the purpose.
2. An emergency existing, this act shall be in force from its
passage.
