Chap. 354.—-An ACT to amend and re-enact Sections 4, 10 and 11, and to
repeal Section 18, of an act entitled “An act to incorporate the town of
Tappahannock, county of Essex”, approved February 12, 1894, as heretofore
amended, and to amend the said act by adding thereto two new sections
numbered 1l-a and 18-a, respectively, section 11l-a providing for the appoint-
ment of a police justice and prescribing his powers and duties, and section
18-a authorizing the council to appoint a town manager and prescribing
his powers and duties, [H B 375]

1. Be it enacted by the General Assembly of Virginia, That sec-
tions four, ten and eleven of an act entitled an act to incorporate the
own of Tappahannock, county of Essex, approved F ebruary twelfth,
eighteen hundred and ninety-four, as heretofore amended, be amended
and re-enacted, and that the said act be further amended by adding
hereto two new sections numbered eleven-a and eighteen-a, respectively,
he said amended and new sections to read as follows:
Section 4. The officers of the town shall consist of a mayor, six
‘ouncilmen, a sergeant, a treasurer, and such other officers as the
council may appoint. The mayor, councilmen and sergeant shall have
ll the power and authority conferred on such officers by the forty-
ourth and the one hundred and ninety-first chapters of the Code of
Virginia of the edition of eighteen hundred and eighty-seven, by all
cts amendatory thereof, and by all laws applicable to towns.
In the event of sickness or absence of the mayor from the town, the
luties of the office shall be discharged by some member of the council,
o be designated by him in writing. and in event the eaid maene cho]
‘ail to so designate, then the council shall elect a mayor pro tempore
‘rom among their members.
In the event of death or resignation of the mayor during his term
»f office, the council shall elect for the unexpired term a mayor, either
‘rom their number or from the qualified voters of the town.
The mayor shall preside at all meetings of the town council and
shall vote only in case of a tie.
All vacancies occurring in the council shall be filled for the un-
-xpired term by the council from among the qualified electors of the
‘own.
The compensation of the mayor and council shall be fixed by a com-
mission in accordance with the provisions of section twenty-nine hun-
Jred and fifty-one of the Code of Virginia, as amended, and the
compensation of the treasurer and sergeant shall be fixed by the
town council.
Section 10. The council shall elect a sergeant for the town, and he
shall have all powers and authority conferred by law upon the sergeants
of towns, and shall discharge the same duties as constables within the
corporate limits of the town, and to the distance of one mile beyond
the same, and be entitled to the same fees as constables, and shall dis-
charge such further duties as the town council may impose.
Section 11. The council may elect a treasurer whose duty it shall
be to collect all the town levies and taxes, and disburse the same by
check, and he shall have the same power of levy or distress in collecting
the said levies and taxes as is now conferred upon county and city
treasurers.
The council may require of him any bond in any penalty with such
sureties as it may deem proper, payable to the town of Tappahannock,
and conditioned according to law for the faithful performance ot said
duties as treasurer of said town. |
Before entering upon the discharge of his duties, he shall take the
oaths required to be taken by the treasurer of the county. He may
be removed by the council at any time from the office of treasurer for
any default in duty, or any failure properly and promptly to account
for any money in his hands, as the council may order or direct. He
shall receive for his services as treasurer such compensation as the
town council may from time to time direct.
Section 1l-a. The mayor, in his discretion with the approval of
the council, may appoint a police justice for the town of Tappahan-
nock, who shall have power and authority and jurisdiction to try viola-
tions of all ordinances of the said town and who shall be clothed witl
all powers and authority in criminal matters within said town as 1s
now conferred upon the mayor of towns in Virginia by the genera
laws of this Commonwealth. When such appointment is made, the
mayor thereof shall by virtue of his office possess no power, authority
or jurisdiction to try violations of the ordinances of the said town 01
to act as police justice except in the event of absence of the police
justice from the said town or his inability to act. The town counci
shall compensate such police justice either by a regular salary or by
fees taxed in the cost of cases heard by him.
Section 18-a. The town council may in its discretion appoint a
town manager as authorized by section twenty-nine hundred and forty-
nine of the Code of Virginia, who shall be clothed with all the authority
vested by the said section in town managers, and shall have such other
and further authority and duties as the town council may impose by
ordinances. In the event of the appointment of a town manager as
herein authorized, such manager may serve as town treasurer or town
sergeant or both in the discretion of the town council.
2. Be it further enacted by the General Assembly of Virginia, That
section eighteen of an act entitled an act to incorporate the town of
Tappahannock, county of Essex, approved February twelfth, eighteen
hundred and ninety-four, as heretofore amended, be and the same
is hereby repealed.
