Chap. 257.-—-An ACT for the relief of John C. Senter, of Roanoke, Virginia ;
J. F. Barbour and Sons, of Roanoke, Virginia, and the Stone Construction
Company of Bristol, Virginia. - [H B 410]

Whereas, in nineteen hundred and thirty-four John C. Senter, of
Roanoke, Virginia, J. F. Barbour and Sons of Roanoke, Virginia, and
the Stone Construction Company, of Bristol, Virginia, entered into
construction contracts with the State Teachers College at Fredericks-
purg, the State Teachers College at Harrisonburg, and the State
Teachers College at East Radford, part of the funds for the payment
of said contracts being furnished to the said colleges by the Federal
Emergency Administration of Public Works; and,
Whereas, there was incorporated in all of said contracts a scale of
wages known as the Governor’s Wage Scale, which wage scale all
of the said contractors used in formulating their bids on which the
said contracts were awarded; and,
Whereas, the Board of Labor Review in Washington, District of
Columbia, increased the labor costs to the said contractors over and
above that called for by the Governor’s Wage Scale set up in their
respective contracts, by the amounts hereinafter set forth; and,
Whereas, the John C. Senter claim has been reduced to judgment
against the State by the circuit court of the city of Richmond, entered
on the ninth day of December, nineteen hundred and _ thirty-seven,
for the sum of five thousand eight hundred and thirty-six dollars and
sixty-three cents ($5,836.63), with interest from February first, nine-
teen hundred and thirty-five ; and,
Whereas, on January eighteenth, nineteen hundred and thirty-eight,
the claims of J. F. Barbour and Sons and the Stone Construction
Company were admitted as being correct by the State Teachers Col-
lege at Fredericksburg and the State Teachers College at Radford,
respectively, before the State Board of Education ; and,
Whereas, the State Board of Education on January eighteenth.
nineteen hundred and thirty-eight, unanimously adopted a resolution
requesting the General Assembly to make an appropriation covering
all three of the hereinafter set forth claims; and,
Whereas, it is proper that the Commonwealth of Virginia shoulc
pay said claims; now, therefofe,
1. Be it enacted by the General Assembly of Virginia, That there
be and is hereby appropriated for the relief of John C. Senter the
sum of five thousand eight hundred thirty-six dollars and sixty-three
cents ($5,836.63), to be paid out of any unexpended balances standins
to the credit of the State Teachers College at Harrisonburg, on the
books of the Division of Accounts and Control at the close of busi
ness on June thirtieth, nineteen hundred and thirty-eight, and if suc
balances are inadequate for the payment of this appropriation it
full the unpaid balance shall be paid out of the amounts appropriate:
for maintenance and operation of the said State Teachers Colleg
at Harrisonburg, for the year ending June thirtieth, nineteen hundre
and thirty-nine; and there is hereby appropriated for the relief o:
J. F. Barbour and Sons the sum of two thousand four hundred anc
seventy dollars ($2,470.00) to be paid out of any unexpended balance:
standing to the credit of the State Teachers College at Fredericks.

and if such balances are inadequate for the payment of this appropria-
tion in full the unpaid balance shall be paid out of the amounts appro-
priated for maintenance and operation of the said State Teachers
College at Fredericksburg for the year ending June thirtieth, nineteen
hundred and thirty-nine: and there is hereby appropriated for the
relief of the Stone Construction Company the sum of seven hundred
thirty-eight dollars and ninety-five cents ($738.95) to be paid out of
any unexpended balances standing to the credit of the State Teachers
College at Radford, on the books of the Division of Accounts and
Control at the close of business on June thirtieth, nineteen hundred
and thirty-eight, and if such balances are inadequate for the payment
of this appropriation in full the unpaid balance shall be paid out
of the amounts appropriated for maintenance and operation of the
said State Teachers College at Radford, for the year ending June
thirtieth, nineteen hundred and thirty-nine. ,
