Chap. 215.—An ACT to amend and re-enact Section 101, as heretofore amended,
of an act entitled “An act to incorporate the city of Newport News, in the
county of Warwick, and to provide a charter therefor”, approved January
16, 1896, in relation to issuance of bonds and the method of voting at elec-
tions thereon. [S B 212]

1. Be it enacted by the General Assembly of Virginia, That sec-
tion one hundred and one, as heretofore amended, of an act entitled
“An act to incorporate the city of Newport News, in the county of
Warwick, and to provide a new charter therefor’, approved January
sixteenth, eighteen hundred and ninety-six, be amended and re-enacted
so as to read as follows:
Section 101. The council may, in the name, and for the use, of
the city, contract debts and make and issue or cause to be made and
issued as evidence thereof, bonds, notes or other obligations upon the
credit of the city, or otherwise as provided by law; provided that no
bond shall be for a longer term than the probable life of the improve-
ment for which the bonds are issued, as determined by the council
by ordinance, and provided further, that all bonds so issued shall be
either serial bonds or sinking fund bonds; and provided, further, that
no ordinance appropriating money, or providing for the issuance of
any bond, note or other obligation upon the credit of the city, for the
purchase of any land for the site for, or for the construction of, any
museum, shall be adopted except and until the same shall be submitted
to a vote of the electors at a special election to be called for the purpose.
Such special election shall be ordered by the judge of the corporation
court of the city of Newport News to be held not less than thirty nor
more than sixty days after the date of the entering of the said order,
upon the petition of the council of the city of Newport News. The
said petition shall contain the proposed ordinance in full in the form
in which it is proposed to submit the same to the electors. At least
ten days before any such election the clerk of the said court. shall cause
such proposed ordinance to be published once in one or more news-
papers of general circulation published in the said city.
There shall be printed on separate lines on the ballots to be use
at any such election, the words “For Bond Issue”, and “Against Bond
Issue’, and immediately to the left of each and on the same line
therewith, a square not less than one quarter nor more than one-half
an inch in size, printed thus:

[] Against Bond Issue.
In any such election the voter shall mark immediately preceding
the proposal he wishes to vote for a check (\/) or a cross (X or +)
or a line (—-) in the square provided for such purpose, leaving the
square preceding the proposal he does not wish to vote for unmarked.
If a majority of the electors voting on such a proposed ordinance
shall vote in favor thereof, it shall, upon the ascertainment and certi-
fication of the result of such election by the commissioners of election,
be ordained by the council of said city at its next regular meeting as
an ordinance of the city.
