Chap. 210.—An ACT to amend the Code of Virginia by adding thereto a new
section numbered 3466-a prescribing the compensation of judges of circuit
courts and of judges of corporation and city courts of record of cities of
the first class, to amend and re-enact Sections 3469 and 3471 of the Code of
Virginia, relating to the compensation of judges, and to repeal Sections
3466, 3468 and 3470 of the Code of Virginia, relating to the same matter,
and an act entitled “An act to continue the salaries of the judges of the
first and tenth judicial circuits”, approved February 18, 1924. [S B 26]

1. Be it enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding thereto a new section num-
bered section thirty-four hundred and sixty-six-a, and that sections
thirty-four hundred and sixty-nine and thirty-four hundred and
seventy-one of the Code of Virginia, be amended and re-enacted, so
that the said new section and the said amended sections shall read
as follows: ,
Section 3466-a. Salaries of Judges of Circuit Courts, Corpora-
tion Courts and City Courts—(a) The judges of the circuit courts,
and the judges of the corporation courts and city courts of record of
cities of the first class other than the judge of the corporation court
of the city of Winchester, shall each receive an annual salary of five
thousand four hundred dollars; the judge of the corporation court of
the city of Winchester shall receive an annual salary of eight hun-
dred dollars as judge of said court; the whole of such salaries shall
be paid out of the State treasury, but the State shall be reimbursed
to the extent of one-half thereof by the respective counties and cities
served by said courts except that of the salary of the judge of the
circuit court of the city of Richmond the State shall pay the propor-
tion which would otherwise fall to the city of Richmond; and it is
hereby made the duty of the Comptroller, on or betore the first day
of June, of each year, to apportion between the counties and cities
served by said courts the salaries of the judges thereof for the year
beginning the first day of February, of the succeeding year, and trans-
mit a statement of such apportionment to the clerk of the council of
each city and the clerk of the board of supervisors of each county
served by said courts and to the treasurer of each of said counties and
cities.
(b) It shall be the duty of the board of supervisors of each county
and the council of each city to provide funds for the payment of so
much of said salary as said statement shows to have been apportioned
to its county or city; but it is hereby made the duty of the treasurer
of such county or city to pay the same into the treasury of the State
on or before the first day of December of each year, out of the funds
of his county or city in his hands, and to this end, he shall retain of
said funds collected by him, a sum sufficient to pay such portion of
said salary, and the said apportionment shall be the first and superior
charge against such funds.
(c) Any treasurer failing to make such payment within the time
prescribed therefor shall be liable to the Commonwealth on his official
bond, for the part of such salary apportioned to his county or city,
and a penalty thereon of ten per centum.
Section 3469. Increase of Salaries of Judges by Cities.—(a)
Any city may, by ordinance, increase the salaries of its corporation,
city and circuit court judges, or any one or more of them, as it may
deem proper. The increase shall be paid wholly by the city and shall
not be diminished during the term of office of the judge whose salary
is So increased.
Section 3471. Salaries of Judges in Cities of Less Than Ten
Thousand Inhabitants——Each city containing less than ten thousand
inhabitants shall pay the salary of the judge of its corporation court.
2. Be it further enacted by the General Assembly of Virginia,
That sections thirty-four hundred and sixty-six, thirty-four hundred
and sixty-eight and thirty-four hundred and seventy of the Code of
Virginia, and an act entitled “an act to continue the salaries of the
judges of the first and tenth judicial circuits”, approved February
eighteenth, nineteen hundred and twenty-four, be, and they are hereby,
repealed.
3. This act shall be in force on and after July first, nineteen hun-
dred and thirty-eight.
