Chap. 177.—An ACT to amend Chapter 94 of the Acts of the General Assembly
of Virginia of 1934, approved March 7, 1934, and known, designated and cited
as the Alcoholic Beverage Control Act, by adding thereto a new section,
numbered Section 35-a, so as, among other things, to provide when and how
a person found guilty of illegal manufacture, possession, transportation, or.
sale of alcoholic beverages may be interdicted; to make possession of alcoholic
beverages by interdicted persons unlawful; and to provide penalties for
violations of the provisions of this section. [H B 340]

1. Be it enacted by the General Assembly of Virginia, That chap-
ter ninety-four of the acts of the General Assembly of Virginia of
nineteen hundred and thirty-four, approved March seventh, nineteen
hundred and thirty-four, and known, designated and cited as the Al-
coholic Beverage Control Act, be amended by adding thereto a new
section, numbered section thirty-five-a, which new section shall read
as follows:
‘Section 35-a. When and how person found guilty of illegal manu-
facture, possession, transportation or sale of alcoholic beverages may
be interdicted; possession of alcoholic beverages by interdicted person
unlawful; violation how punished—(a) When any person has been
found guilty of the illegal manufacture of alcoholic beverages, or
illegal possession of alcoholic beverages, or the illegal transportation
of alcoholic beverages, or the illegal sale of alcoholic beverages, the
court, or the judge thereof, the justice, mayor or other officer trying
the case, may without further notice or additional hearing enter an
order of interdiction prohibiting the sale of alcoholic beverages to such
person for one. (1) year from the date of the entry of the order, and
thereafter if further ordered. Such orders of interdiction shall be
published in the same manner and shall have the same effect as orders
of interdiction provided for in section thirty-five of this act.
'. (b) The possession of alcoholic beverages, except such alcoholic
beverages as may have been, or may be, acquired in accordance with
the provisions of sections thirty-two, thirty-three and thirty-four, or
either of them, of this act by any person who has been interdicted
under the provisions of this act, shall be unlawful, and any interdicted
person found in possession of alcoholic beverages in violation of the
provisions of this section shall, notwithstanding any other provision
of this act to the contrary, be guilty of a misdemeanor and punished
as provided in section sixty-two of this act.
2. An emergency existing, this act shall be in force from its pas-
sage.
