Chap. 148.—An ACT to prohibit the use of the word “certified” or other like
word or form of words in advertising or selling of hatchery products, poultry
breeding stock, chicks or turkey poults in the State of Virginia unless in-
spected and certified as provided for in this act; to provide for such inspection
and certification; and to prescribe penalties. [S B 178]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. It shall be unlawful for any person, firm or corpor-
ation to use, orally or in writing, relative to any hatchery products,
poultry breeding stock, chicks or turkey poults, sold or advertised or
offered for sale in this State, the term “certified”, alone or with other
words, or to so use any other term or form of words which suggests
that there has been inspection and certification, or either, unless such
hatchery products, poultry breeding stock, chicks, or turkey poults,
have been certified as hereinafter provided.
Section 2. If such hatchery products, poultry breeding stock,
chicks or turkey poults were produced in another state or in a foreign
country, certification by the legally constituted inspection official of such
state or country or of the United States shall be sufficient; but if such
hatchery products, poultry breeding stock, chicks or turkey poults
were produced in Virginia, certification shall be by the Division of
Markets of the Department of Agriculture and Immigration. The
director of the said Division of Markets with the approval of the
Commissioner of Agriculture and Immigration shall adopt and promul-
gate appropriate standards for general health, vigor, type and produc-
tion for certifying such hatchery products, poultry breeding stock,
chicks, or turkey poults as are suited to the needs of agriculture in
this and other states.
Section 3. Any person, firm or corporation who shall violate any
of the provisions of section one of this act, shall be guilty of a mis-
demeanor, and upon conviction shall be punished by a fine of not
less than ten ($10.00) dollars and not to exceed five hundred ($500.00)
dollars. Each violation shall constitute a separate offense.
Section’ 4.°. The Director of the Division of Markets, with the ap-
ews of the Commissioner of Agriculture and Immigration, is hereby
empowered and directed, in his discretion, to cause prosecutions for
violation of this act to be instituted through the Commonwealth’s at-
torneys of this State, or ‘otherwise, in counties or cities of the State
of Virginia where in his opinion violations of this act are found.
