Fish and Dog Code of Virginia (Chapter 247, Acts 1930), as amended by
Chapter 195, Acts 1936, approved March 14, 1936, relating to special fees

1. Be it enacted by the General Assembly of Virginia, That section
nineteen-f of the Game, Inland Fish and Dog Code of Virginia (chap-
ter two hundred and forty-seven, acts nineteen hundred and thirty)
as amended by chapter one hundred and ninety-five, acts nineteen hun-
dred and thirty-six, approved March fourteenth, nineteen hundred and
thirty-six, be and the same is hereby amended and re-enacted so as
to read as follows: ! a
Section 19-f. Big game stamp.—There shall be a special stamp
for hunting bear, deer and elk in this State, which shall be in addition
to regular season license required to hunt other game; provided that
such special stamp shall not be required of any person to hunt bear
and deer in the county where they are legal voters, or in which they
are stationed or located, or of which they are resident within the mean-
ing of section twenty-two, chapter two hundred and forty-seven, acts
nineteen hundred and thirty, as amended by chapter twenty-four, acts
approved January fourteenth, nineteen hundred and thirty-seven, but
such special stamp shall be required of all persons to hunt elk. The
fee for such special stamp shall be one dollar to a resident and two
dollars and fifty cents to a nonresident. Such special stamp may be
obtained from the clerk or agent of any county or city whose duty
it is to. sell hunting licenses, The clerk or agent shall write or stamp
date of issue on the face of the special.stamp and the same shall be
adhesively affixed to the back of license to hunt by the user who shall
cancel the same with his initials in ink. Failure to affix and initial
said special stamp to the license before hunting bear, deer or elk shall
be a misdemeanor. The money realized from the sale of special stamps
shall be used so far as necessary for the payment of damages to crops
by elk; provided that there shall not be paid on account of such
damage to crops in any county in one fiscal year more than the amount
received from the sale of such stamps in said county for the same fiscal
year. If the amount so received in such county in any fiscal year is in-
sufficient to pay such damages in full, the funds in hand for such
fiscal year shall be paid pro-rata. Any person whose crops are damaged
by elk, shall forthwith file his claim, duly sworn to, with the game
warden of the county, stating the nature of the damage and the amount
claimed by him. The game warden shall promptly investigate the
claim and reach an agreement with the claimant if possible and if he
and the claimant can not agree on the amount of damage, the same
shall be submitted to arbitration in the usual manner. The award of
the arbitrators shall be final and binding. The game warden shall
promptly report to the commission the amount of each such claim so
agreed upon by him and the claimant, or determined by arbitration.
