Chap. 186.—An ACT for the Relief of the Sureties of John L. Boughton,
lute Sheriff of Essex County, Virginia.
Approved March 14, 1872.
1. Be it enacted by the general assembly of Virginia, That
authority be given to the auditor of public accounts to suspend
the collection of two judgments in the name of the common-
wealth, one against J. H. C. Jones and A. C. Walker, executors
of Peter Toombs, deceased, and the other against Thomas
H. Simcoe (which said Peter Toombs and Thomas H. Simcoe
were sureties for John L. Boughton, late sheriff of Essex
county), for a period of twelve months, provided he shall be
satisfied that the same are sufficiently secured, but nothing
herein contained shall be construed to prolubit the auditor
from collecting the same whenever he may think proper to
do so.
2. The auditor of public accounts is authorized, and hereby
required, upon a settlement of the aforesaid judgments, to
receive from the surviving surety, or the executors of the
deceased surety, in discharge of the said judgments against
them respectively, the payment of the principal with interest,
at sufficient costs and expenses of collection, abating there-
from the damages and excess of interest which have been
awarded for the default of the said principal, and upon the
satisfaction of either of the said judgments, the other shall be
considered as discharged.
3. This act shall be in force from its passage.
