Chap. 178.—An ACT to Amend tho 40th Section of Chapter 101 of the
Code of 1860 to Prevent the Destruction of Wild Fowl in this State.
Approved March 13, 1872.
1. Be it enacted by the general assembly of Virginia, That
the fortieth section of chapter one hundred and one of the
Code of 1860, relative to the destruction of wild fowl, shall be,
and the same is hereby amended and re-enacted so as to read
as follows:
<40. If any person, except from the land, shall shoot at or
kill wild fowl during the night within this state, or if any per-
Son shall from a skiff or float, or by the aid thereof, within the
jurisdiction of the counties of Accomack, Fairfax, Prince Wil-
liam, Stafford, Northampton, Charles City, Henrico, or King
George, whether in the night or day-time, shoot or kill wild
fowl, he may be convicted thereof before a justice, and on con.
viction, shall surrender his gun and any such skiff or float, and
the same shall be forfeited to the commonwealth. If he fail tc
surrender them, he shall be committed to jail for thirty days.
unless the surrender be sooner made; and if any person offend.
ing against this section be not an actual resident of this state
he shall, moreover, forfeit two hundred dollars; and if any
non-resident of this state shall, in like manner from a skiff 01
float, or by the aid thereof, in the broad waters of Back bay
within the jurisdiction of the county of Princess Anne, or ir
any other waters of this commonwealth, shoot or kill wild fowl,
he may be proceeded against by warrant and be convicted
before any justice having jurisdiction, and upon such convic-
tion shall be fined for every offence, not less than ten nor more
than fifty dollars, to be recovered as other fines are recoverable
by law, to be collected and paid for the use and benefit of the
literary fund; but this section shall not be applicable to non-
residents renting shores on the said broad waters of Back bay
or on any other waters of this commonwealth.
§ 2. This act shall be in force from its passage.
