Chap. 85.——An ACT to validate the action of the town of Culpeper, acting
through its properly constituted authorities, in the sale of certain property
belonging to the town of Culpeper to V. Von Gemmingen, who was town
manager of the town of Culpeper, by deed dated February 11, 1932. [S B 177]

Whereas, the town of Culpeper, on the second day of October,
nineteen hundred and thirty-one, purchased certain property known
as the “Vass” property located, lying and being within the corporate
limits of the town of Culpeper, for the purpose of extending one of
its streets through said property; and,
Whereas, after the acquisition of said property, a part of same
was used for the purpose for which it was bought, a part of the
residue thereof was sold to the Standard Oil Company of New
Jersey, and the rest and residue of same was, by proper action of the
town council taken on the second day of February, nineteen hundred
and thirty-two, sold to V. Von Gemmingen, who was at that time
town manager for the town of Culpeper, for the price of thirty-five
hundred dollars; and,
Whereas, the said V. Von Gemmingen did on the eleventh day of
February, nineteen hundred and thirty-two, secure a deed to the said
property purchased by him, from the proper officials of the town of
Culpeper and paid to the town of Culpeper the sum of thirty-five
hundred dollars, cash in full of the agreed purchase price of said prop-
erty ; and,
Whereas, a question has arisen as to the rights of the town of
Culpeper to convey the property to its town manager, under the
statute laws of this State, and the legal title to the portion of the
Vass property purchased and paid for by V. Von Gemmingen has
become involved; now, therefore,
1. Be it enacted by the General Assembly of Virginia, That the
action of the council of the town of Culpeper in authorizing the sale
of a lot or parcel of land lying in the north end of the town of
Culpeper, Virginia, and being part of the Vass property purchased
by the town of Culpeper on the second day of October, nineteen hun-
dred and thirty-one, and conveyance by the town of Culpeper of the
said lot of land to the said V. Von Gemmingen by deed dated the
eleventh day of February, nineteen hundred and thirty-two, which
said deed has been duly recorded in the clerk’s office of Culpeper
County, Virginia, in deed book ninety-four, at page one hundred and
forty-six, shall be valid and legal; and the action of the council of
the town of Culpeper in selling said lot of land to the said V. Von
Gemmingen, and the act of the town of Culpeper in conveying said
land by said deed is declared valid and legal.
2. An emergency existing to validate such deed, this act shall take
effect from its passage.
