Chap. 70. —An ACT to amend and re-enact Section 2942 of the Code of Vir-
ginia, as heretofore amended, in relation to the councils of cities and towns
under the city or town manager plan, so as to provide for certain charter
amendments. [S B 145]

1. Be it enacted by the General Assembly of Virginia, That section
twenty-nine hundred and forty-two of the Code of Virginia, as here-
tofore amended, be amended and re-enacted so as to read as follows:
Section 2942. City or Town Manager Plan.—Under this plan all
the legislative powers of the city or town, however conferred or pos-
sessed by it, are hereby vested in a council of three or five members,
in cities or towns of ten thousand inhabitants or under; and of from
five to eleven members in cities of above ten thousand inhabitants.
Said council shall be elected at large, and shall have the duty of ap-
pointing the city or town manager, as the case may be, who need not
be a resident of the city or town or of the State. The council shall
elect one of its members to preside over its meetings, who shall be ex
officio mayor; he shall be elected for a term of two years, and any
vacancy in the office shall be filled by election by the council for the
unexpired term; and the mayor shall have the same powers and duties
as other members of the council, with a vote, but no veto, and shall be
the official head of the city or town. With the exception of those of-
ficers required by the Constitution of the State to be elected by popular
vote the members of the council shall be the only elective city or town
officials. Notwithstanding the provisions of this section, any such city
or town may, by charter amendment enacted at any time after the
adoption by such city or town of the city or town manager form of
government, make provisions concerning the election of the council,
the selection of the mayor, and the terms of office of the councilmen
and the mayor, different from the provisions hereinabove prescribed.
2. An emergency existing, this act shall be in force from its pas-
sage.
