Chap. 311.—An ACT to validate the proceedings and acts of the council, the
election officials and certain officers, of the town of Berryville, in connection
with the ordering and holding of an election on the question of the issuing of
$30,000.00 of bonds of said town to provide a sewerage system and disposal
plant, and in connection with the issuance of said bonds and fixing the rate
of interest thereon; and to provide that said bonds shall be valid and binding
obligations of said town. [H B 544]

1. Be it enacted by the General Assembly of Virginia, That all the
proceedings and acts of the town council, the election officials, and the
mayor and clerk of council, or recorder or acting recorder, of the town
of Berryville, in connection with calling for, ordering, and holding, an
election in said town on the question of issuing thirty thousand dollars
of bonds of said town for the purpose of providing a sewerage system
and sewerage disposal plant for the town, and in the issuance of said
bonds, are hereby validated, regardless of any defects, irregularities, or
inconsistencies in such proceedings, in the ordering and holding of said
election, or in the actual issuance of said bonds, even though issued at
a different rate of interest than that prescribed by the ordinance of the
council asking for said election, or in the order of the circuit court of
Clarke county directing the holding thereof, said election having been
held on December tenth, nineteen hundred and thirty-five, and the said
bonds having been issued to bear date as of March first, nineteen hun-
dred and thirty-six, and to bear interest at the rate of three and one-
half per centum per annum; and the said bonds as so issued, are
hereby validated and declared to constitute valid and binding obligations
of the town of Berryville, in the hands of the purchasers thereof,
whether sold before or after the effective date of this act.
2. An emergency existing, this act shall be in force from its passage.
