Chap. 266.—An ACT to authorize the State Highway Commissioner to convey
the interest of the Commonwealth in certain property in Henrico county,
which is no longer needed for highway purposes, to Anna E. Wagner, in
exchange for a parcel of property now owned by Anna E. Wagner, which
is needed for highway purposes. [H B 217]

Whereas, the Commonwealth of Virginia secured certain real
estate in Henrico county, Virginia, from the Sandston Railway Com-
pany, by deed dated July thirtieth, nineteen hundred and thirty-four,
recorded in deed book two hundred and sixty-a, page sixty-four,
clerk’s office of Henrico Circuit Court, which included a strip of land
of undetermined acreage fronting on the property of Anna E. Wagner
near Tair Oaks, Virginia, a portion of which is no longer needed
for highway purposes ; and
Whereas, the Commonwealth of Virginia, through the Department
of Highways, is anxious to secure from Anna E. Wagner a parcel
of land containing nine-one hundredths (0.09) acre, located in
Henrico county, Virginia, to be used as a part of State highway
number four; and
Whereas, the said Anna E. Wagner has agreed to convey to the
Commonwealth said parcel if the Commonwealth will convey its
interest in that portion of the property which it secured from the
Sandston Railway Company that fronts on the Wagner property,
which is no longer needed for road purposes; now, therefore,
1. Be it enacted by the General Assembly of Virginia, That upon
the receipt of a good and sufficient deed of general warranty, prop-
erly executed and acknowledged, from Anna E, Wagner, conveying
to the Commonwealth of Virginia a parcel of land containing nine-
one hundredths (0.09) acre at Fair Oaks, Virginia, the State High-
way Commissioner is authorized and empowered, in the name of and
on behalf of the Commonwealth of Virginia, to convey unto Anna E.
Wagner, by an appropriate and proper deed, all right, title and
interest in that portion of land which the Commonwealth of Virginia
obtained from the Sandston Railway Company by deed dated July
thirtieth, nineteen hundred and thirty-four, recorded in deed book
two hundred and sixty-a, page sixty-four, clerk’s office of Henrico
Circuit Court, which fronts on the property of Anna E. Wagner,
with the exception of a parcel containing fifty-five-one hundredths
(0.55) acre which is to be retained by the Commonwealth of Virginia
for road purposes. The portion released unto said Anna E, Wagner
is deemed by the State Highway Commissioner as no longer neces-
sary for road purposes.
2. The parcel of land which is to be thus acquired from Anna E.
Wagner is outlined in yellow on a map entitled “Plat showing that
portion of land obtained from the Sandston Railway Company front-
ing on the Anna Wagner property near Fair Oaks, in Henrico county,
which is to be retained by the Commonwealth of Virginia for road
purposes—Virginia Department of Highways, project one thousand
and sixty-nine-C—January fifteenth, nineteen hundred and thirty-six.
Scale one inch equals fifty-feet, now on file in the office of the Depart-
ment of Highways, Richmond, Virginia.”
The said portion to be retained by the Commonwealth of Virginia
for road purposes is outlined in red on said map.
3. An emergency existing, this act shall be in full force and effect
upon its passage.
