Chap. 233.—An ACT to amend Chapter 6 of an act entitled “An act to provide a
charter for the city of Petersburg,’ approved March 11, 1875, as heretofore
amended, by adding thereto a new section numbered 7, in relation to bringing
actions against the city for damages. [S B 188]

1. Be it enacted by the General Assembly of Virginia, That chapter
six of an act entitled ‘an act to provide a charter for the city of
Petersburg,” approved March eleventh, eighteen hundred and seventy-
five, as heretofore amended, be amended by adding thereto a new sec-
tion numbered seven, which new section shall read as follows:
CHAPTER VI
Section 7. No action shall be maintained against the city for dam-
ages for any injury to persons or property or for wrongful death
alleged to have been sustained by reason of the negligence of the city
or of its officers, agents or employees, unless a written statement of
the claimant, his agent, attorney or his personal representative, of the
nature of the claim and of the time and place at which the injury is
alleged to have occurred or to have been received, and of the circum-
stances under which such injury is alleged to have occurred, shall have
been filed with the city attorney or the city manager within thirty days
after such cause of action shall have accrued, except that where the
claimant is an infant or is non compos mentis, or otherwise physically
disabled by such injury, or where the injured party dies within thirty
days after such injury, such statement may be filed within sixty days;
any statements pursuant to this act shall be valid notwithstanding any
provisions of the charter of said city or of the general law.
