Chap. 185.—-An ACT to authorize and provide for the inspection of herring in
certain cases, by persons licensed or employed for the purpose, by the Director
of the Division of Markets; to provide for the payment of inspection fees,
and to appropriate the money derived therefrom; and to make certain cer-
tificates of inspection prima facie evidence for certain purposes. [S B 161]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. The Director of the Division of Markets, with the ap-
proval of the Commissioner of Agriculture and Immigration, is hereby
authorized, when requested by any party financially interested in any
lot of herring to be packed or cured, to investigate and certify the
quality, condition, grade or other classification of such herring, under
such rules and regulations as he may prescribe, including payment of
such fees as he deems reasonable for the services rendered or performed
by employees or licensed agents of the Division of Markets of the
Department of Agriculture and Immigration.
Section 2. All fees and moneys collected or received by employees
or licensed agents of the Division of Markets of the Department of
Agriculture and Immigration in their official capacities shall be paid
into the State treasury to be there maintained in a separate fund which
is hereby appropriated through the Department of Agriculture and
Immigration to the Division of Markets for carrying out the provisions
of this act.
Section 3. The Director of the Division of Markets with the ap-
proval of the Commissioner of Agriculture and Immigration may
appoint employees or license agents to assist in carrying out the provi-
sions of this act, may fix their compensation and remove such ap-
pointees at any time.
Section 4. Certificates of Inspection and re-inspection issued under
this act by authorized agents of the Division of Markets of the Depart-
ment of Agriculture and Immigration, and those relating to the grade,
classification, quality or condition of herring to be packed or cured,
issued under authority of the Congress of the United States, shall be
accepted in any court of this Commonwealth as prima facie evidence
of the true grade, classification, condition or quality of such herring
at the time of their inspection.
