Chap. 403.—An ACT for the relief of William A. Tuck, guardian of Helen
Mitchell Morgan. [S B 115]

Whereas, on the twenty-second day of November, nineteen hundred
and thirty-two, while Helen Mitchell Morgan, a girl then ten years of
age, together with a number of other children, were walking along a
State highway in Halifax county, on their way from school to their
respective homes, they were approached by a road machine drawn by
a tractor which was being driven by an employee and agent of the
State Highway Commission, who undertook to pass the children with-
out stopping, and in doing so, he carelessly and negligently drove the
said tractor and road machine against the said Helen Mitchell Morgan
with such force that one of her legs was broken between the knee and
hip, as a result of which, she had to be, and was, taken to a hospital
at South Boston for treatment. On November twenty-fifth her leg
was put in a plaster cast and so remained until January seventh, nine-
teen hundred and thirty-three, when it was removed, after which, it
was found that the fracture had not properly healed, and on January
twentieth, nineteen hundred and thirty-three, she was taken to a hospital
in Lynchburg where she remained under treatment, with her leg again
in a plaster cast, until March third, when she was taken to her home
where she remained until April third when she was taken back to the
hospital and the cast finally removed; and,
Whereas, as a result of the foregoing recited facts, William A. Tuck,
the duly appointed and qualified guardian of the said Helen Mitchell
Morgan, necessarily, and without fault upon the part of himself or his
said ward, incurred costs and expenses incident to the treatment of his
ward, including medical and hospital bills, amounting in the aggregate
to the sum of six hundred and seventy-two dollars, which he has been
compelled to pay out of the estate of his said ward and for which, he
has no right of action against the State Highway Commission; now,
therefore, in consideration of the premises,
1. Be it enacted by the General Assembly of Virginia, That the
Comptroller be, and he is hereby, authorized to issue his warrant on
the Treasurer of Virginia in favor of William A. Tuck, guardian of
Helen Mitchell Morgan, for the sum of six hundred and seventy-two
dollars, to compensate him for the expenses necessarily incurred by
him on account of the said negligent act of the said agent and employee
of the State Highway Commission, and the Treasurer of Virginia is
hereby authorized to pay the said amount to the said William A.
Tuck, guardian of Helen Mitchell Morgan, out of funds appropriated
to the State Department of Highways.
