Chap. 255.—An ACT to amend and re-enact section 5337 of the Code of Virginia,
as heretofore amended, relating to answers of guardians ad litem and infants
in certain cases. [H B 115]

1. Be it enacted by the General Assembly of Virginia, That section
fifty-three hundred and thirty-seven of the Code of Virginia, as here-
tofore amended, be amended and re-enacted so as to read as follows:
Section 5337. Guardian ad litem to be appointed.—To every infant
or insane defendant to a suit brought under this chapter, there shall be
appointed a guardian ad litem, who, as well as the infant (if over
fourteen years of age) shall answer the bill on oath in proper person.
But if such infant over fourteen years of age shall be beyond the limits
of the Commonwealth or is insane, or confined in any reformatory or
prison, or refuses to answer, no answer shall be required of the said
infant in his proper person. Whenever the guardian ad litem shall
file an answer in his proper person, it shall be unnecessary for the
guardian ad litem to file an answer for the infant or insane defendant
by himself as guardian ad litem.
