Whereas, H. B. Wilkins, a coal dealer in the city of Portsmouth,
in reporting his gross purchases as the basis for determining the amount
of his license tax for the years nineteen hundred and thirty-one, nine-
teen hundred and thirty-two and nineteen hundred and _ thirty-three,
inadvertently included therein the freight paid by him on the materials
so purchased during each of said periods; and,
Whereas, the said Wilkins was assessed with, and paid a license tax
for each of said years, based on his gross purchases plus the freight
so paid by him, with the result that the license tax so paid by him for
said years exceeded the amounts of such tax if the same had only
been assessed on the basis of his gross purchases as provided by law,
as follows: for the year nineteen hundred and thirty-one, the sum of
thirty dollars and six cents; for the year nineteen hundred and thirty-
two, the sum of thirty-three dollars and forty-four cents; and for the
year nineteen hundred and thirty-three, the sum of thirty-one dollars
and eighty-one cents making an aggregate amount of ninety-five dol-
lars and thirty-one cents, which amount was improperly and unlawfully
paid by the said H. B. Wilkins into the State treasury ; now, therefore,
1. Be it enacted by the General Assembly of Virginia, That there
be, and is hereby, appropriated to the said H. B. Wilkins out of any
moneys in the State treasury not otherwise appropriated, the sum of
ninety-five dollars and thirty-one cents to reimburse him for the
amounts of money so improperly and unlawfully paid by him into the
State treasury, the same to be paid by the Treasurer on the warrant
of the Comptroller.
