Chap. 161.—An ACT to prohibit misrepresentation of the grade, quality and con-
dition of agricultural and other products and commodities; and to prescribe
penalties for violation of the provisions of this act. [H B 338]

Be it enacted by the General Assembly of Virginia, as follows:
1. Misrepresentation by advertising in the press, and/or by radio
and/or misrepresentation by letter, statement, mark representing grade,
quality or condition; label and/or otherwise in handling, selling, offer-
ing or exposing for sale any agricultural commodities is hereby pro-
hibited.
2. Any person, firm, association, or corporation who shall violate
any of the provisions of this act shall be punished by a fine of not less
than five ($5.00) dollars nor more than five hundred ($500.00) dollars
for each offense.
3. The Director of the Division of Markets, with the approval of
the Commissioner of Agriculture and Immigration, is hereby empowered
and directed, in his discretion, to cause prosecutions for violation of
this act to be instituted through the Commonwealth’s attorneys of this
State, or otherwise, in counties or cities of the State of Virginia where
in his opinion violations of this act are found.
4. If any section, sub-section, clause or phrase of this act is for any
reason held to be unconstitutional, such decision shall not affect the
validity of the remaining portions of this act.
