Chap. 111.—An ACT to amend and re-enact sections 4, 9, and 18-a, of an act of
the General Assembly of Virginia, approved on the 22nd day of March, 1924,
entitled an act to provide for a new charter for the city of Roanoke, to re-
peal the existing charter of said city and the several acts amendatory thereof,
and all other acts or parts of acts inconsistent with this act, so far as they
relate to the city of Roanoke. [S B 268]

1. Be it enacted by the General Assembly of Virginia, That sections
four, nine, and eighteen-a, of an act approved on the twenty-second day
of March, nineteen hundred and twenty-four, entitled an act to provide
a new charter for the city of Roanoke, to repeal the existing charter
of said city and the several acts amendatory thereof, and all other acts
or parts of acts inconsistent with this act, so far as they relate to the
city of Roanoke.
Section 4. Composition of council; vacancies——The council shall
consist of five members, who shall be elected at large and shall serve
for a term of four (4) years, from the first day of September next
following the date of their election and until their successor shal.
have been elected and qualified; provided, however, that at the first
election hereunder, three councilmen shall be elected to succeed those
whose terms expire on the thirty-first day of August, nineteen hundrec
and thirty-four, and at the next election two councilmen shall be electec
to succeed those whose terms expire on the thirty-first day of August
nineteen hundred and thirty-six. The council shall be a continuing
body, and no measure pending before such body shall abate or be dis.
continued by reason of the expiration of the term of office or remova’
of the members of said body, or any of them. Vacancies in the council
shall be filled within thirty days, for the unexpired term, by a majority
vote of the remaining members.
Section 18-a. The council may, in its discretion, combine the offices
of civil and police justice and issuing justice at such time as it may
deem expedient, whether the term of the issuing justice has expired or
not, whereupon the civil and police justice or his assistant shall exercise
all the powers and perform all the duties conferred by law upon the is-
suing justice and the civil and police justice; and in the event of such
two offices being combined, as aforesaid, the office of the issuing justice
shall thereupon be abolished and the assistant civil and police justice
shall, in addition to his other duties, act as clerk to the civil and police
justice and receive such compensation as the council may prescribe.
Council:may also abolish the office of high constable, whether the
term of said high constable has expired or not, and may confer the
duties of high constable upon the sergeant of the city of Roanoke.
No action shall be taken by the council under this section until the
expiration of the present terms of the issuing justice and high constable.
