Chap. 76.—An ACT to vest in the State board of education certain property and
property rights formerly vested in the board of trustees of the State teachers
college at Farmville, formerly known as the State female normal school for
women at Farmville, and in the board of the Virginia teachers colleges; and to
authorize the State board of education to convey its right, title and interest in
and to a certain lot of land, and a perpetual easement over another lot of land,
to the town of Farmville. | [S B 123]

Whereas, a number of years ago, the State teachers college at
Farmville, acquired for the use and benefit of said school, a certain lot
situate in the town of Farmville, abutting, and lying on the eastern
side of Randolph street, and between the right of way of the Norfolk
and Western Railway Company and the Appomattox river, said lot
being designated as lot number thirty in the St. George Randolph sub-
division of Farmville, a map of which subdivision is recorded in the
clerk’s office of Prince Edward county; and,
Whereas, about the year eighteen hundred and ninety-two, the
town of Farmville closed and abandoned that part of Randolph street
between the said railroad right of way and said river, by constructing
a-town power plant thereon; and,
Whereas, the said town of Farmville is desirous of acquiring what-
ever right, title and interest is vested in the said State teachers college
at Farmville to such portion of said lot as lay within the limits of the
street lines of said Randolph street, and also a perpetual easement, or
right of way, over said lot number thirty, as the same is now being
used ; and, :
Whereas, by sections nine hundred and thirty-nine and nine hun-
dred and forty-two of the Code of Virginia, as amended by an act ap-
proved February thirteenth, nineteen hundred and twenty-four, the
board of the Virginia teachers colleges was given the supervision,
management and government of the State teachers college at Farm-
ville, and succeeded to all the property, property rights, duties, con-
tracts and agreements formerly controlled by and vested in the board
of trustees of the State teachers college at Farmville, formerly known
as the State female normal school for women at Farmville; and,
Whereas, under and by virtue of the provisions of section fifteen of
chapter thirty-three of the Acts of the General Assembly of Virginia
of nineteen hundred and twenty-seven, approved April eighteenth,
nineteen hundred and twenty-seven, entitled “an act to reorganize the
administration of the State government, et cetera,” and upon the reor-
ganization of the State board of education under the provisions of
section one hundred and thirty of the Constitution of Virginia, as
amended, the board of the Virginia teachers colleges was abolished
and all its powers and duties were transferred to, and vested in, the
State board of education, but no express provision was made for di-
vesting the board of the Virginia teachers colleges of the property and
property rights which had theretofore been vested in it; now, there-
fore, |
1. Be it enacted by the general assembly of Virginia, That all property
and property rights formerly vested in the board of trustees of the State
female normal school for women, at Farmville, now the State teachers
college at Farmville, and its successor, the board of the Virginia
teachers colleges, and which have not been otherwise disposed of, are
hereby transferred to, and vested in the State board of education.
2. The State board of education is hereby authorized and em-
powered, by apt and proper deed to be executed by its president and
secretary, and under its official seal, to convey to the town of Farm-
ville, all its rights, title and interest in and to that part of the lot here-
inbefore mentioned, which lies within that portion of Randolph street,
which has been closed and abandoned as hereinbefore set forth, and
also to convey to the said town a perpetual easement, or right of way,
over said lot number thirty in the said St. George Randolph subdi-
vision, as the same is now being used. |
3. An emergency existing, this act shall be in force from its
passage. ,
