Chap. 4.—An ACT to amend the Code of Virginia by adding thereto a new section,
to be numbered and designated as section 2072-a, relating to the appointment
of special police officers for policing toll bridge properties. [H B 8]

1. Be it enacted by the general assembly of Virginia, That the Code
of Virginia, be amended by adding thereto a new section, to be num-
bered and designated as section twenty hundred and seventy-two- a,
which new section shall read as follows:
Section 2072-a. The circuit court of any county, or the judge
thereof in vacation, in which there is a toll bridge and/or its ap-
proaches; or a circuit court of any county, or the judge thereof in va-
cation, in which lies any part of any toll bridge, or bridges, and/or
their approaches belonging to the same proprietor, but which bridge
or bridges and/or their approaches lie in more than one county or
counties, may, upon the application of such proprietor, appoint any
employee of such proprietor, employed in and about the control and/or
the operation of such bridge or bridges, and approaches, special police
officers who may exercise all the powers and duties imposed and con-
ferred upon sheriffs in this State, in criminal matters, upon any such
bridge, or bridges, and/or their approaches. And such power shall
extend throughout the State when such special police is actually in
pursuit of a person accused of crime, and/or when acting under au-
thority of a warrant duly issued for the arrest of a person charged
with a crime. Provided, however, that no special policeman, appointed
under this section, and whose duties, as such special policemen, are
merely incidental to such private employment shall be deemed to be an
employee of the State, and/or county, or counties, within which such
bridges and their approaches lie, within the meaning of the Virginia
workmen’s compensation act.
Before any such appointment is made the court, or judge thereof,
in vacation, shall be satisfied that such person has been a bona fide
resident of this State for more than one year immediately preceding
such appointment, and of good moral character; and before he be per-
mitted to discharge any of the duties of such special policeman, he
shall take the oath required by law, and shall give a bond payable to
the Commonwealth of Virginia in the penalty of not less than five hun-
dred dollars, conditioned for the faithful discharge of his official duties.
No salary shall be paid to any special police officer appointed under
this section, by the State, or county, or counties, in which such proper-
ties lie; but he shall not receive any fees for making any arrest, exe-
cuting any warrant, summoning a witness, or carrying a person to or
from jail.
