Chap. 365.—An ACT to prohibit, under certain circumstances, the issuance of a
certificate pursuant to section 7 of chapter 419, of the Acts of Assembly, 1930,
permitting the use of any of the improved public highways in the interstate
transportation of passengers or freight. [S B 237]

1. Be it enacted by the general assembly of Virginia, That upon
receipt from a person, firm or corporation, desiring to use any of the
improved public highways of this State in the interstate transportation
of passengers and freight, of application for a certificate so to do, as:
required by section seven of chapter four hundred and nineteen of the
Acts of Assembly, nineteen hundred and thirty, the State corporation
commission shall, before issuing said certificate, inquire into the traffic
conditions prevailing along the highway or highways over which said
person, firm or corporation desires to operate; and, if said commission
shall find that, because of existing traffic conditions on the particular
highway or highways in question, or any part thereof, the operation
of the number and kind of vehicles intended to be used, or the schedule
on which they are to be operated, will thereby unduly endanger the life
and property of the general public using said highway or highways,
and will thereby subject the general public to a danger more than that
which is ordinarily incidental to the use of such highway or highways,
then the said commission shall refuse to issue the said certificate.
