Chap. 301.—An ACT to authorize boards of supervisors of counties, in their
discretion, to temporarily transfer a portion of the road funds derived from the
State tax on gasoline and other motor vehicle fuels and from local levies, to
the school funds for use during the present school year, where the same may be
necessary to prevent the schools from closing before the expiration of an
eight months’ session. . [S B 246]

1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of any county is hereby authorized, in their dis-
cretion, to temporarily transfer a portion of the road funds of such
county, derived from the State tax on gasoline and other motor vehicle
fuels and from local levies, to the school funds of such county, for use
by the county school board during the present school year, where the
same may be necessary to prevent the public schools of such county
from closing before the expiration of an eight months’ session, but only
so much thereof as may be necessary for that purpose.
The amount so transferred by the board of supervisors of any
county shall be returned not later than three years from the date on
which the same was so transferred, which return shall be accomplished
by transferring the same from the school funds back to county treasury
to the credit of the road fund, if such fund exists at that time, and if
not, to the credit of the general county fund.
- 2. An emergency existing this act shall be in force from its
passage.
