Chap. 286.—An ACT to authorize and empower the school board of the city of
Roanoke to sell and dispose of certain real estate to the city of Roanoke for
public street purposes. [H B 206]

Whereas, the school board of the city of Roanoke in the year nine-
ccen hundred and twenty purchased certain real estate abutting Church
avenue and Third (Roanoke) streets, southwest, in the city of Roan-
oke, said property to be used along with other property owned by the
schcol board in the same block for the purpose of erecting a new high
school building thereon ; and
Whereas, said real estate so purchased by the school board of the
city of Roanoke, as aforesaid, was paid for from the proceeds of bonds
authorized by popular vote and issued by the city of Roanoke for the
purpose aforesaid ; and
Whereas, subsequently to the date of the acquisition of said real
estate as aforesaid, the school board changed its mind and purchased
another site upon which a high school building was erected, and failed
to use the said real estate for the specific purpose for which it was
acquired, and abandoned it for that purpose; and
Whereas, a portion of the property so purchased by the school
board was exchanged by the school board and the city of Roanoke
along with other property owned by the school board, with the United
States government for certain property owned by the United States
government as a site for a new post office building, said exchange
having been made in accordance with law; and
Whereas, after the exchange aforesaid, there was left a strip of
land twenty-one and fifty-eight hundredths feet wide (21.58) by
one hundred forty-eight and five-tenths (148.5) feet long extending
from second (Commerce) street to a fourteen foot alley, and lying
parallel with Church avenue, and a piece of land lying at the southeast
corner of Church avenue and Third (Roanoke) street southwest, and
extending along Church avenue, a distance of one hundred fifty and
nine-tenths (150.9) feet, and on Third (Roanoke) street southwest,
ninety-four and twenty-four hundredths (94.24) feet; and
Whereas, after the exchange of a portion of the land with the
United States government as a site for a post office as aforesaid, the
balance of the land was so situated that it was not susceptible of use
for high school or any other school purposes ; and
Whereas, said land is needed by the city of Roanoke for street pur-
poses in connection with the post office building erected by the federal
government adjoining said land; and
Whereas, the school board has entered into an agreement to sell
said real estate hereinafter described to the city of Roanoke and that
the title now vested in the school board of the city of Roanoke may be
vested in the city of Roanoke, the said city of Roanoke to pay there-
for to the school board for school purposes the sum of thirty-four
thousand nine hundred eighty-seven dollars and nineteen cents
($34,987.19), whenever: said amount shall be needed and required for
the erection or improvement of school buildings, said agreement being
subject to the confirmation by the general assembly of Virginia, and
such action as shall be necessary to the proper and legal transfer of
title to said land; now therefore:
1. Be it enacted by the general assembly of Virginia, That the sale
of said property hereinafter described by the school board of the city
of Roanoke to the city of Roanoke be, and the same is hereby author-
ized, ratified and confirmed in accordance with the provisions of the
agreement aforesaid, and that title to said real estate hereinafter de-
scribed, now vested in the school board of the city of Roanoke shall,
by operation of law, be vested in the city of Roanoke immediately
upon the taking effect of this act.
Said real estate is bounded and described as follows:
PARCEL NUMBER ONE
Beginning at a point on the southeast corner of Church avenue
southwest, and Third street (sometimes called Roanoke street) thence
north eighty-one degrees fifty-nine minutes and twenty-seven seconds
east one hundred fifty and nine-tenths feet to a fourteen foot alley ;
thence with west line of same south eight degrees, eighteen minutes
and forty-six seconds east ninety-four and twenty-four hundredths
feet to a point; thence south eighty-two degrees, nine minutes and
fifteen seconds west one hundred fifty and nine-tenths feet to a point
on the east line of Third street ; thence with same north eight degrees,
eighteen minutes, forty-six seconds west ninety-four and twenty-four
hundredths feet to the place of beginning. :
PARCEL NUMBER ‘Two
Beginning at a point on the west side of Second street southwest
(sometimes called Commerce street) south eight degrees, eighteen
minutes and seventeen seconds east seventy-three and five-tenths feet
from the southwest corner of Second street and Church avenue; thence
with the west line of Second street south eight degrees, eighteen min-
utes and seven seconds east twenty-one and fifty-eight hundredths feet
to a point; thence south eighty-two degrees, nine minutes and fifteen
seconds west one hundred forty-eight and five-tenths feet to a fourteen
foot alley ; thence with said line of same north eight degrees, eighteen
minutes and seven seconds west twenty-one and fifty-eight hundredths
feet to a point ; thence north eighty-one degrees, fifty-nine minutes and
twenty-seven seconds east one hundred forty-eight and five tenths feet
to the place of beginning.
2. An emergency existing this act shall be in force from its
passage.
