Chap. 269.—An ACT for the protection of fish, squirrels and other game in
Buchanan county. [H B 126]

Be it enacted by the general assembly of Virginia as follows:
1. It shall be unlawful for any person to take, catch or destroy
in any of the waters of Buchanan county any fish between the thirty-
first day of January and the first day of July following.
Any person violating the provisions of this section shall, upon con-
viction, be fined not less than five nor more than twenty-five dollars.
2. It shall be unlawful for any person to catch or take any fish in
any of the waters of Buchanan county at any time by means of drag
seines or tramel nets of any kind. It shall be unlawful for any person
to have in his possession any such seine or tramel net, and any such
seine or tramel net shall by order of court or justice be forfeited to
the Commonwealth, and may be seized by any officer as forfeited, and
the court or justice shall order the same to be destroyed.
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than twenty-five dollars nor more
than two hundred dollars, and confined in jail for a period of not less
than ten nor more than thirty days.
3. It shall be unlawful to use fish berries, lime, giant powder,
dynamite, guns or any explosive or chemical substance of any kind for
the destruction, taking or catching of fish in any creek, pond, river or
waters of Buchanan county at any time. .
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than fifty dollars nor more than two
hundred dollars, and confined in jail for a period of not less than one
month nor more than six months.
4. It shall be unlawful for any person to hunt or trap any squirrel
in Buchanan county between the thirty-first day of December and the
fifteenth day of September following. It shall also be unlawful for
any person to catch or kill more than ten squirrels in one day, and it
shall be unlawful for any person to buy or sell, or offer to buy or sell,
any squirrel or squirrels caught or killed in Buchanan county, or to
take any squirrel or squirrels caught or killed in said county out of
said county for the purpose of buying or selling the same.
5. It shall be unlawful to hunt or trap any racoon in Buchanan
county between the first day of January and the fifteenth day of
November following. ,
Any person violating any of the provisions of section four and sec-
tion five of this act shall, upon conviction, be fined not less than ten
dollars nor more than fifty dollars.
6. To hunt or trap, as used in this act, includes pursuing, shooting,
killing, capturing, trapping, snaring and netting wild animals, and
lesser acts, such as wounding, placing, setting, drawing or using any
net or device to hunt or trap wild animals, and any act of assistance
to any other person in hunting or trapping or attempting to hunt or
trap wild animals. To catch, take or destroy fish as used in this act,
or to unlawfully use any of the things mentioned in sections two or
three for that purpose, shall include any attempt to do any of said acts.
