Chap. 223.—An ACT to give the State corporation commission authority to regu-
late the transportation of explosives by persons, firms, associations, and cor-
porations other than transportation companies. [H B 220]

1. Be it enacted by the general assembly of Virginia, That no per-
son, firm, association, or corporation not a transportation company
within the meaning of section thirty-nine hundred and twenty-two of
the Code of Virginia, shall knowingly transport by motor truck or
other vehicle, or by air plane or other air ship, within the limits of this
Commonwealth, any explosive compounds except in the manner pre-
scribed by the State corporation commission. It shall be the duty of

the State corporation commission, from time to time, within its dis-
cretion, to make rules and regulations governing the transportation of
explosives within this State by such persons, firms, associations or cor-
porations, and the methods of marking and packing such explosives.
The State corporation commission shall have the authority to exempt
from the provisions of its rules, the transportation of explosives in
amounts of two hundred pounds, or less, by the ultimate consumer of
the same. Nothing herein shall be construed to empower the State
corporation commission to promulgate or enforce any rules affecting
the transportation by the ultimate consumer, of explosives upon the
premises owned or controlled by such consumer. The rules of the
State corporation commission shall be promulgated and enforced in
the same manner as provided by the Constitution and laws now in
force, or hereafter enacted, prescribing rules and regulations govern-
ing transportation companies generally.
