Chap. 216.—An ACT to authorize the board of supervisors of Campbell county to
construct and maintain sidewalks along the public roads and highways in such
county. [H B 273]

1. Be it enacted by the general assembly of Virginia, That, in order
to promote the safety and protection of pedestrians, the board of su-
pervisors of Campbell county may construct and maintain sidewalks,
along the public roads, including State highways, in said county, and
either on one side, or on both sides, thereof, the cost of such sidewalks
to be paid out of the road funds, or any other funds of the county
available for such purpose.
The board of supervisors of such county may acquire necessary
rights of way for such sidewalks in like manner as they are author-
ized by law to acquire rights of way for public roads, and with like
rights of appeal, or may construct and maintain them, where practi-
cable so to do, on the rights of way previously acquired for said public
roads and highways, provided, that no such sidewalks shall be con-
structed on existing rights of way of State highways but with the
consent and approval of the State highway commissioner.
When such board of supervisors shall agree upon a location of any
such sidewalks, they shall make a record thereof in their minute book,
setting forth therein, the names of the abutting land owners and the
length of the sidewalk along each such owners property.
The action of the board of supervisors in locating any such side-
walk shall be subject to review by the circuit court of the county, on
the petition of any person aggrieved thereby, setting forth the nature
of the proceeding which he desires to be so reviewed, provided such
petition be filed in the clerk’s office of said court within thirty days
after the date of entry by the board of the order showing the location
of such sidewalk and a copy thereof served, within the same period,
on the chairman of said board; and the judgment of the circuit court
thereon shall be final. |
2. An emergency existing, this act shall be in force from its
passage.
