Chap. 54.—An ACT to Incorporate the Lee Monument Association.
Approved January 25, 1871.
Whereas, it appears to the general assembly that an associa-
tion has been formed for the purpose of raising by individual
subscription and contribution, a fund to erect, at the city of
Richmond, a monument in memory of General Robert E. Lee,
and also to provide a suitable resting place for his remains, in
connection with an addition to the said monument; and whereas,
it also appears that the said association has been organized with
the following officers, to wit: Jubal A. Early, President; Wal-
ter H. Taylor, Bradley T. Johnson, Robert Stiles, Robert D.
Minor, Robert H. Maury, Thomas H. Carter, and Charles S.
Venable, Executive Committee; Thomas M. R. Talcott, Sec-
retary; William H. Palmer, Treasurer; and Charles P. Allen,
Auditor:
1. Be it therefore enacted by the general assembly, That the
said Jubal A. Karly, Walter H. Taylor, Bradley T. Johnson,
Robert Stiles, Robert D. Minor, Robert H. Maury, Thomas
H. Carter, Charles S. Venable, Thomas M. R. Talcott, Wil-
liam H. Palmer, and Charles P. Allen, and their successors in
office and associates, be and they are hereby constituted a body
politic and corporate, under the name and style of The Lee
onumental Association; and by that name and style shall be
subject to all the provisions, and entitled to all the rights, pow-
ers, privileges, and immunities prescribed by existing laws, in
so far as the same are applicable to like corporations and the
purposes of said association, and are not inconsistent with this
act. )
2. The said association shall have power to provide for rep-
resentation, in its general meetings and elections, of the indi-
vidual subscribers to the fund raised by subscription ; to in-
crease or diminish the number of its officers; to change their
designation and prescribe their duties; to appoint collecting
agents, and to hold them to a strict accountability; to require
of its receiving and disbursing officers bonds, with security,
conditioned for the faithful performance of their duties; and
to make all needful by-laws and regulations, consistently with
the laws of the state, for the management of its property, and
the due and orderly conducting of its affairs.
3. It shall be lawful for the said association to raise, by in-
dividual subscription and contribation, such sum of money as
may be necessary for its purposes, and to acquire, by purchase
or gift, within the corporate limits of the city of Richmond, a
lot of ground, not to exceed one square, as laid out in the plot
of said city, and to hold and improve the same for the legiti-
mate purposes of the association; but if said association shall
prefer to locate the proposed monument outside of the corpo-
rate limits of the city of Richmond, then it shall be lawful for
it to acquire, by purchase or gift, a lot or parcel of land adja-
cent to the said city, not to exceed ten acres, and to hold and
improve the same for the purposes aforesaid. Any lot of
ground within the corporate limits of the city of Richmond,
or parcel of land outside of said limits, which may be ac-
quired under this section, shall be held sacred to the purposes
of the said association, as recognized in this act, and such kin-
dred objects as the association may, from time to time, adopt,
and which may not be inconsistent with the laws of the state.
4. If the said association shall determine not to acquire a
separate lot within the city of Richmond, or parcel of land
outside of said city, for the location of the proposed monument,
then it shall be lawful for the said association to erect the said
monument in Hollywood cemetery, or on some public lot or
square within the said city, as may be agreed upon: provided,
it shall acquire the privilege of doing so from the proper
authorities; and it shall do so subject to such conditions as
may be stipulated for with the said authorities.
9. It shall also be lawful for said association to provide a
final resting place for the remains of General Robert E. Lee,
with the assent of the members of his immediate family, either
at the place at which said monument may be erected, or at
some other place within the limits of the state, with the privi-
lege of making provision for the interment of other members
of his family at the same place, as the association may direct;
and it shall also be lawful for the said association to procure
the execution of as many statues of General Robert E. Lee, in
marble, bronze, or other material, as it may deem proper, with
a view to their distribution and location at suitable points.
6. If from any cause the said association shall cease to exist,
and not be revived within a reasonable time, the property
which may be acquired by it within the state, shall revert to
the commonwealth of Virginia, and be held sacred to the pur-
poses for which it shall have been originally acquired.
7. This act shall be in force from its passage.
