Chap. 88.—An ACT to amend and re-enact sections 5, 7, 8, 9 and 13 of chapter
101, of the acts of the general assembly of Virginia, 1922, providing a new
charter for the town of Galax. [H B 151]

1. Be it enacted by the general assembly of Virginia, That
sections five, seven, eight, nine and thirteen of chapter one hundred
and one of the acts of nineteen hundred and twenty-two, approved
February twenty-fifth, nineteen hundred and twenty-two, for the
town of Galax, be amended and re-enacted so as to read as follows:
Section 5. The mayor shall be elected for a term of two years;
and at the next town election to be held in June, nineteen hundred
and twenty-eight, three councilmen shall be elected for a term of
two years, and three for a term of four years; and the three coun-
cilmen receiving the highest number of votes of said election shall
be declared elected and shall serve for a term of four years: and,
the three receiving the next highest number of votes of said elec-
tion shall be declared elected and shall serve for a term of two
vears; and, thereafter each councilman shall be elected for a term
of four years at the expiration of their respective terms. Said
mayor and councilmen shall be elected on the second Tuesday in
June immediately preceding the expiration of the terms herein
provided for, and shall enter upon their duties upon the first day
in September next succeeding their election.
Section 7. The municipal officers of said town shall in addition
to said mayor and councilmen, consist of a treasurer, sergeant,
clerk of the council, town manager, town assessor and such other
officers as may be provided for by the town council and the council
may appoint such committees of the council and create such
boards and departments of town government and administration
with such powers and duties and subject to such regulations as
it may seem fit, consistent with the provisions of this act and the
general laws of this State and any number or all of the offices
provided for by this section may be held by one man.
Section 8. A treasurer, clerk of the council, sergeant, city
manager and town assessor, or such of them as the said council
ot said town shall deem expedient and proper for the best interests
ot said town shall be appointed by the council at its first regular
meeting in October after each town election, or as soon thereafter
as 1s possible and convenient and shall assume the duties of their
ofhce on the first day of January next succeeding. Their term of
othce shall be for two years from the time fixed for their assum-
ing the duties of their office and thev shall serve until their suc-
cessors shall have qualified.
Section 9. The duties and compensations of all municipal offi-
cers except as herein or hereafter by the general laws of the State
defined or provided for shall be defined and prescribed by the town
council. The town assessor in the year nineteen hundred and
twenty-eight and every year thereafter shall assess the real estate
and tangible personal property in said town at a fair market value
as provided by the Constitution or the Code of Virginia, and the
manner and detail of said assessment of said real estate and tangi-
ble personal property aforesaid, as well as the assessment of all
other properties for town purposes, shall be made by said town
assessor in the manner prescribed by the town council, said assess-
ment being for town purposes only.
Section 13. When the mayor, councilmen, treasurer, sergeant
and town assessor take the oaths required of them, triplicate certifi-
cates of the court, or person administering the same, stating the
facts of their having been taken shall be obtained by the person
taking the same and be by him delivered for record as follows:
one to the clerk of the circuit court of Grayson county; one to the
clerk of the circuit court of Carroll county; one to the clerk of the
town council. When any other municipal officer takes the oath
required of him a certificate as aforesaid shall be secured by him
and delivered to the clerk of the council only.
2. An emergency existing, this act shall be in force from its
passage.
