Chap. 76.—An ACT to amend and re-enact section 2769 of the Code of Vir-
ginia. as heretofore amended, concerning the pay of supervisors. [S B 30]
Approved February 29, 1928.
1. Be it enacted by the general assembly of Virginia, That sec-
tion twenty-seven hundred and sixty-nine of the Code of Virginia,
as last amended by chapter sixty-three of the acts of the general
assembly of Virginia of nineteen hundred and twenty-seven, be
further amended and re-enacted so as to read as follows:
Section 2769. Each member of the board of supervisors shall be
allowed, and paid out of the county levy, a compensation for his
services in attending the meetings of the board and in discharging
such other duties as may be imposed upon him by law at a rate of
not exceeding six dollars per diem for the time he shall be actually
so employed, and five cents for each mile of travel in going to and
returning from the place of meeting of said board, but no per diem
allowance shall be made for any time occupied in traveling where
mileage is allowed therefor, and only one mileage shall be allowed
for any one term of meeting of such board; provided, that on and
after July first, nineteen hundred and twenty-four, the rate of com-
pensation for such services of members of the board of supervisors
of the county of Floyd shall not be more than five dollars per day
and mileage, instead of six dollars per day and mileage, as afore-
said; and provided, further, that on and after January first, nineteen
hundred and twenty-eight, the rate of compensation for such serv-
ices of members of the hoard of supervisors of the county of Bote-
tourt shall not be more than five dollars per day and actual expenses
while attending meetings of the board. instead of six dollars per day
and mileage, as aforesaid; provided, that in the county of Louisa,
the supervisors shall receive no mileage.
No supervisors shall draw pav for more than eighteen days in
counties of ten thousand population and less, except that super-
visors in the county of Dickenson may draw pay for not more than
twenty-five davs; nor shall he draw pay for more than twentv-five
davs in counties of more than ten thousand and less than thirty
thousand population, nor shall he draw pav for more than thirty
days in counties of thirtv thousand population and not over forty
thousand, and counties of over forty thousand population he shall
draw pav for not more than fortv days in any one year; provided,
that the provisions of this section shall not prevent supervisors in
the counties which have special road laws from receiving additional
compensation for services in connection with road work done under
said special road laws now existing, or as hereafter amended. if such
compensation be allowed in such special road law. But nothing in
this act shall allow a member of the board of supervisors to draw
pay on the same day for services as supervisor and as inspector or
commissioner of roads or construction of bridges. With the consent
of the circuit court of their respective counties, the supervisors of
Henrico and Nansemond counties mav receive as much as four hun-
dred dollars each per annum and the supervisors of Arlington
county may receive as much as twelve hundred dollars each per
annum, and the supervisors of Roanoke county, with the consent of
the circuit court of said county may receive as much as two hundred
and fifty dollars each per annum, and mileage as above provided,
and the supervisors of the county of Henry, with the consent of the
circuit court of said county, may receive as much as two hundred
dullars each per annum, and mileage as above provided, and the
supervisors of the county of Chesterfield, with the consent of the
circuit court of said county, may receive as much as three hundred
dollars each per annum, and mileage as above provided, and the
supervisors of the county of Alleghany, with the consent of the cir-
cult court of said county, may receive as much as six hundred dol-
lars each per annum and mileage as above provided, and the super-
visors of the county of Rockingham, with the consent of the circuit
court of said county, may receive as much as three hundred dollars
each per annum and mileage as above provided, and the supervisors
ot the county of Shenandoah, with the consent of the circuit court
of said county, may receive as much as one hundred and seventy-
hve dollars each per annum, and mileage as above provided; and the
supervisors of Elizabeth City county may receive as much as one
hundred and fitty dollars each per annum, in addition to the com-
pensation they would be entitled to receive under the general pro-
Visions of this section, the same to be paid upon warrants issued by
said board on the general county fund of said county.
Furthermore, each member of the board of supervisors of Staf-
ford, King George, Isle of Wight, Nansemond, Prince Edward,
Prince William, Northampton, James City, New Kent, Charles City,
York, Warwick, Hanover, Gloucester, Scott, Russell, Surry, Sussex
and Prince George and Craig, Madison and Rockingham and West-
moreland counties may be paid as compensation for his services in
the supervision of the opening and repair of the public roads or
construction and repair of bridges of said counties not exceeding five
dollars per diem for the time he shall be necessarily so employed;
provided, that the supervisors of Culpeper county may receive three
dollars per day when so engaged; but no supervisor shall receive
for such services compensation to exceed one hundred and fifty dol-
lars per annum in addition to the amount allowed by laws for other
services, except that the supervisors of Rockingham county may re-
ceive not exceeding two hundred and fifty dollars for such services.
In the county of Augusta any supervisor may, with the consent of
the circuit court, be paid as compensation for his services as as-
sistant to the superintendent of roads in the supervision or con-
struction and repair of public roads or bridges, or for any special
duties imposed upon him by the board of supervisors, at the rate of
tour dollars per diem for the time actually engaged, with mileage,
as provided for regular service, but this extra compensation shall
not exceed the sum of three hundred dollars per year for any one
supervisor, and the supervisors of the county of Norfolk may re-
ceive an amount not exceeding five hundred dollars each per an-
num and mileage as herein provided.
Any supervisor of Orange county may act as road commissioner
for his district and shall be paid for his services three hundred dol-
lars per annum. Each supervisor of the counties of Buchanan,
Mecklenburg, Sussex and Greensville may, in addition to mileage,
receive the sum of eight dollars per day during the time the boards
of said counties are in actual session, and each supervisor of Pittsyl-
vania county and Halifax county may act as road commissioner for
his magisterial district in supervising road construction and mainte-
nance and may receive as such six dollars per day for not exceed-
ing fifty days in any one year; and for his services as supervisor
while the board is in actual session, he shall receive six dollars per
day for not exceeding fifteen days for any one year and mileage as
herein provided. But nothing herein shall be construed to prevent
the members of the board of supervisors of Franklin county from
receiving compensation for their services as provided by an act ap-
proved March fourteenth, nineteen hundred and twenty-four as
amended.
An emergency exists and this act shall be in force from and after
its passage.
