Chap. 522.—An ACT to continue the war memorial commission created by an
act approved March 20, 1924, and continued by an act approved March 24,
1926; to provide for the erection of a memorial in the form of a carillon to
the patriotism and valor of the soldiers, sailors, marines and women from
Virginia who served in the world war; and to appropriate moneys to carry
out the provisions of this act. [S B 2]

Whereas, the general assembly, by an act approved March twen-
tieth, nineteen hundred and twenty-four, created a war memorial com-
mission for the purpose of erecting in the city of Richmond a mem-
orial to the patriotism and valor of the soldiers, sailors, marines, and
women from Virginia who served in the world war; and,
Whereas, the general assembly, by an act approved March twenty-
fourth, nineteen hundred and twenty-six, continued the war memorial
commission aforesaid and definitely committed the State to the caril-
lon; and directed the commission to make a report to the general as-
sembly at its session of nineteen hundred and twenty-eight; and
Whereas, the commission aforesaid has made such report to the
general assembly at its present session; now, therefore,
1. Be it enacted by the gencral assembly of Virginia, That the war
memorial commission, created and continued by the acts aforesaid
shall, subject to the provisions of this act, proceed with all reasonable
dispatch to do all things necessary to erect or cause to be erected ir
the capital city of the Commonwealth, on the site tendered by the city
of Richmond to the Commonwealth, which site has been conveyec

without cost to the Commonwealth, a memorial in the form of a
carillon to the patriotism and valor of the soldiers, sailors, marines,
and women from Virginia who served in the world war, at a cost to
the State of not exceeding the sum of two hundred and fifty thou-
sand dollars. For the year beginning March first, nineteen hundred
and twenty-eight, there is hereby appropriated to the war memorial
commission, out of any moneys in the State treasury not otherwise
appropriated, the sum of fifty thousand dollars, and for nineteen hun-
dred and twenty-nine, there is hereby appropriated to the war mem-
orial commission, out of any moneys in the State treasury not other-
wise appropriated, the further sum of twenty-five thousand dollars.
The sums hereby appropriated shall be disbursed by the State treasurer
on warrants of the comptroller issued on vouchers signed by the chair-
man of the war memorial commission, countersigned by its secretary.
2. But the provisions of the foregoing section of this act are sub-
ject to the following qualifications: That no appropriation hereby
made shall become available for expenditure unless and until the said
war memorial commission shall have raised or caused to be raised,
by popular subscription or otherwise at least the sum of seventy-five
thousand dollars for the purchase of the bells for the carillon; and
unless and until provision for the perpetual upkeep and maintenance
of the war memorial shall have been made by the city of Richmond or
by private persons or associations, either or both giving such guaran-
tees as shall be satisfactory to the governor, approved by the attorney
general.
3. When the conditions set out in the preceding paragraph of this
act shall have been met, the war memorial commission shall enter into
contracts for, and begin the construction of, the memorial, which cun-
tracts shall be binding upon the State within the limits of the appropria-
tion of seventy-five thousand dollars made by this act to the said war
memorial commission, plus the sum of one hundred and seventy-five
thousand dollars.
The said war memorial commission shall be continued during and
after the construction of the war memorial as herein provided, until
the general assembly of Virginia shall otherwise provide, and shall he
the official custodian of said war memorial, and have complete control
thereof.
