Chap. 258.—An ACT to Incorporate the Fauquier Turnpike Company in
the County of Fauquier. .
Approved March 29, 1871.
1. Beit enacted by the general assembly, That it shall be
lawtul to open books for receiving subscriptions to an amount
not exceeding one hundred thousand dollars, in shares of
twenty-five dollars each, to constitute a joint capital stock
company for constructing a graded or macadamized turnpike
road from Paris, in the county of Fauquier, to a point where
the Marsh road crosses Deep run, the route of said road be-
tween its termini to be selected and fixed by a majority of
the stockholders to be hereinafter incorporated.
2. That books of subscription shall be opened under the
superintendence of Albin 8. Payne, Gurley R. Hatcher, De-
catur B. Hall, Cash Cologue, James 8S. Turner, Thomas Love,
John B. Withers, Robert H. Downman, William H. Gaines,
H. F. Payne, John S. Mosby, James V. Brooke, Eppa Hunton,
William H. Payne, T. N. Fletcher, Addison Utterbach, Charles
H. Gordon, Gilbert M. Bastable, W. W. Rogers, Lewis Sha-
mate, Wellington Mellon, B. F. Rixey, J. D. Fullus, Thomas
F. Foster, John H. Rixey, John A. Spilman, Peter Bowen,
Robert Bensly, and James V. Chilton, or any three of them
at Warrenton, or any other places that a majority of said
commissioners shall appoint, and it shall be lawful for said
commissioners to receive subscriptions in money, labor, (to be
expended on said road) or any article of merchandize, trade or
other property, common and saleable in the county, at such
prices, and payable at such times as may be agreed upon at the
time the subscription is made between the commissioners and
stockholders. |
3. That when ten thousand dollars shall have been sub-
scribed, the stockholders, their executors, administrators, and
assigns, shall be and they are hereby incorporated into a com-
pany, by the name and style of The Fauquier Turnpike Com-
pany, subject to the provisions of the laws of the state; and
it shall be lawful for the stockholders, after one month’s pub-
lic notice given, to assemble in the town of Warrenton and
elect three superintendents of the said road, whose duty it
shall be to let to contract, and superintend the construction
and the making of the same. The said stockholders shall also
have power to make such by-laws, and appoint such other offi-
cers as they may deem necessary and proper in the construc-
tion of said work.
4, 'That said company are hereby authorized to build lateral
or branch roadg in any direction, not exceeding ten miles
each; and for such purpose, may open books of subscription at
such places and times, and under such regulations and persons,
as the board of directors may prescribe.
5. That the subscribers may designate, at the time of sub-
scription, to which section their subscriptions must be applied,
1nd that no portion of the subscription so made shall be ap-
plied to any other portion of the road, but the one to which
the subscription shall be made, without the consent of the
subscriber.
6. That the directors shall be so arranged ag to represent
all sections of the road; and in case of death, resignation, or
other incapacity of a director, the board of directors may sup-
ply the vacancy until the next general meeting of the com-
any. :
‘T. That the said company may, with the consent of the
county court, (or board of supervisors, as may be provided by
general law,) occupy any turnpikes that may have been aban-
doned to the county, and any county roads or bridges built
by the county; and that the county of Fauquier may subscribe
to the capital stock of said company any sum under fifty thou-
sand dollars, in the mode now or hereatter to be prescribed by
law: provided, that no bonds issued by the county shall be
paid to said company at a faster rate than the private subscrip-
tions shall be paid in.
8. That it shall be lawful for said company to issue, as part
of its capital stock, bonds to the amount of twenty-five thou-
sand dollars, each bond for the sum of one hundred dollars,
payable in ten years, and bearing interest at the rate of eight
per centum per annum.
9. That said road shall be thirty feet wide, and it shall be
lawful, as soon as any section of five miles is completed, to
charge the rate of toll prescribed by law.
10. That any five commissioners hereby appointed, may s8e-
lect other commissioners, not exceeding three, for such sec-
tions of said turnpike as may not be represented in the list of
commissioners set forth in this charter.
11. This act shall be in force from and after its passage.
