Chap. 488.—An ACT to amend and re-enact section 3146 of the Code of Vir-
ginia, relating to the commission of fisheries. [S B 234]

1. Be it enacted by the general assembly of Virginia, That section
thirtv-one hundred and forty-six of the Code of Virginia be amended
and re-enacted so as to read as follows:
Section 3146. For the purpose of enforcing the laws relating to the
fisheries of tidewater Virginia, the commission of fisheries heretotore
created, shall consist, as at present, of five members appointed by the
governor, at least two of whom shall be from the tidewater section of
the State, and at least one of these shall come from the eastern side
of the Chesapeake bay.
One of the said tidewater members shall be designated by the gov-
ernor as commissioner of fisheries, who shall be ex-officio chairman
of the commission of fisheries and chief inspector.
The terms of office of the commission of fisheries shall be as
follows:
The commissioner of fisheries, for a term of four years from the
hrst day of July, nineteen hundred and twenty-six; three members
for a term of four years each from July first, nineteen hundred and
twenty-six, and one member for a term of two years from July first,
nineteen hundred and twenty-eight, so that the term of office of all
members of the commission of fisheries shall expire July first, nine-
teen hundred and thirty, and thereafter their successors shall be ap-
pointed by the governor for a term of four years each.
The governor shall have power to remove any, or all of them for
malfeasance, misfeasance, or neglect of official duty, and to fill any
vacancy or vacancies which may occur.
All members of the commission shall be sworn into office in the
presence of the secretary of the Commonwealth, who shall thereupon
issue to each of them their commissions as such, designating the com-
missioner of fisheries, said commissions to bear the signatufe of the
governor, countersigned by the secretary of the Commonwealth under
the seal of the State.
The commissioner of fisheries shall enter into bond in the penalty
of five thousand dollars, with surety to be approved by the governor,
payable and conditioned as required by section two hundred and sev-
enty-nine of the Code of Virginia.
All members of the commission shall be paid their actual expenses
incurred in the performance of their duties. The salaries of the mem-
bers of the commission shall be as follows:
The commissioner of fisheries, four thousand dollars per annum,
payable monthly; each of the other four members of the commission
shall receive ten dollars per day for each day they are actually engaged
in the performance of their duties as such, not to exceed, however, the
sum of two hundred and forty dollars each per annum.
2. This act shall be in force on and after July first, nineteen hun-
dred and twenty-eight.
