Chap. 43.—An ACT to authorize the city of Newport News to borrow eighty
thousand dollars and to issue bonds therefor, to be used by said city in making
public improvements in territory annexed to the city of Newport News, under
Provisions of section 2958 of the Code of Virginia, as amended by act of
general assembly of Virginia, 1924, chapter 441. [H B 40]

l. Be it enacted by the general assembly of Virginia, That in
addition to any other indebtedness of the city of Newport News
and the certificates of debt or bonds which the said city has, from
time to time issued, the council of said city may, by four-fifths vote
thereof, in the name of and for the use of said city, cause to be
Issued bonds or certificates of indebtedness (the form of which
shall be preserthed by the council) to the amount of eighty thousand
dollars, bearing interest at a rate not to exceed six per centum
per annum, and pavable in the discretion of the council in not
more than twenty years, which said bonds may be either sinking
tund or serial bonds, as the council may determine. The proceeds
derived from the sale of said bonds to be set aside and used by the
city tor the purpose of making public improvements, under the
provisions of section twenty-nine hundred and fitty-cight, of the
Code of Virginia, as amended by the acts of the assembly of nine-
teen hundred and twenty-four, chapter four hundred and forty-
one, in territory annexed to the said city from the county of Eliza-
beth City, under order of the circuit court of said county, entered
on the thirtieth day of April, nineteen hundred and twenty-six, in
lieu of all revenues derived by said city from taxation in said an-
nexed territory during the part of the five years provided by law,
remaining from the date the said order of court went into effect.
There shall annually be assessed, levied and collected upon all tax-
able property of the city of Newport News, subject to city taxa-
tion, a tax sufficient to provide for the payment of the principal
and interest of said bonds.
2. In that the order of court aforesaid prescribes a limit of two
vears within which the said city is to proceed to provide an adequate
sewer system in the annexed territory, an emergency is hereby
declared to exist and accordingly this act shall be in force and
effect from its passage.
