Whereas in the year nineteen hundred and twenty-four, C. T.
Baker was tried in the circuit court of Lunenburg county, on a charge
of a violation of the prohibition laws and was convicted and fined
one hundred and fifty dollars and cost, and with the permission ot
the court, in lieu of paying the same in cash, he executed a note with
accepted security, for the entire amount of said fine and costs, which
note was left with the said John L. Yates, who was clerk of the said
court; and
Whereas the said John L. Yates, believing the note to be good,
paid the amount of said fine, to-wit: The said sum of one hundred
and fifty dollars into the State treasury, for the benefit of the literary
fund, expecting to retain the same out of the amount of said note
when collected : and
Whereas afterwards judgment was obtained on said note in favor
of the Commonwealth in one action brought by the attorney for the
Commonwealth for the said county, but it has not been possible to
collect the amount thereof, and it now seems improbable that the same
can ever be collected; and
Whereas the said John L. Yates can have no relief except through
the general assembly of Virginia; now, therefore,
I. Be it enacted by the general assembly of Virginia, That there be,
and is hereby, appropriated for the benefit of the said John L. Yates,
and to reimburse him for the money so paid by him as hereinabove set
forth. the sum of one hundred and fifty dollars, the same to be paid
hy the treasurer on a warrant to be drawn by the comptroller, and the
amount thereof charged to the literary fund.
