Chap. 173.—An ACT to amend and re-enact section 2194 of the Code of Vir-
ginia, relating to unpresented checks. [S B 245]

1. Be it enacted by the general assembly of Virginia, That section
twenty-one hundred and ninety-four of the Code of Virginia be
amended and re-enacted so as to read as follows:
Section 2194. The State treasurer be and is required at the end of
each fiscal year to charge off the books in his office all checks drawn
by him on State depositories which have not been presented for pav-
ment within two years from the date of issuance, and to certify the
lact to the comptroller and to the State depositories; and the comp-
troller, if the warrant is issued by him, to re-issue his warrant and the
treasurer to pay the same if any such check ts thereafter presented.
All checks heretofore or hereafter drawn by the State treasurer,
not presented within two vears for payment, shall, at the end of each
fiscal year, be charged off the book, and he shall notify the comptroller
if warrant is issued by him, and the State depositories of all checks
marked off under the provisions of this act, and the State depositories
shall not pay said checks after the receipt of said notification. Any
checks barred by this act may be presented to the comptroller if the
warrant is issued by him, or if the warrant has been issued previous to
the passage of this act by the auditor of public accounts, or by the
second auditor of Virginia, or if warrant is issued by State treasurer
on investment accounts, said check shall be taken up and warrant 1s-
sued by comptroller or by the State treasurer, if drawn by him, in each
respective case, for the amount thereof and State treasurer shall pay
same.
An emergency existing this act shall be in force on and after
March first, nineteen hundred and twenty-eight.
