I. Be it enacted by the general assembly of Virginia, That sec-
tion forty-four hundred and five of the Code of Virginia, be amended
and re-enacted so as to read as follows:
Section 4405. If any person commit robbery by partial strangu-
lation, or suffocation, or by striking or beating, or by other violence
to the person, or by the threat or presenting of firearms, or other
deadly weapon or instrumentality whatsoever, he shall be punished
with death, or by confinement in the penitentiary for life, or for
any term not less than eight years. If any person commit a
robbery in any other mode, or by any other means, he shall be con-
fined in the penitentiary not less than five years nor more than ten
years.
