Chap. 209.—An ACT to Incorporate the Norfolk and Kempsviile Turnpike
Company.
Approved March 28, 1871.
1. Be it enacted by the general assembly, That it shall be
lawful to open books, under the direction of John B. White-
head, General Richard L. Page, Robert L. Owen; G. F. B.
Leighton, Charles W. Wilson, Thurman Hoggard, Burr S.
Cratt, William F. Shield, O. F. Baxter, and such other person
or persons as any three of the above named persons may ap-
point, and at such time and place as they may select, for the
purpose of receiving subscriptions to a joint capital stock, not
exceeding in the whole, thirty thousand dollars, to be divided
into shares of twenty dollars each, for the purpose of con-
structing a turnpike road from the city of Norfolk to Kemps-
ville by the nearest feasible route.
2. When five thousand dollars shall have been subscribed,
the subscribers, their executors, administrators, and assigns,
shall be and they are hereby incorporated into a company, by
the name and style of The Norfolk and Kempsville Turnpike
Company, subject to the provisions of the Code and Statutes
of Virginia, except so far as modified by this act: provided,
that the said subscriptions shall be paid in as may be required
by the board of directors, when organized.
3. The said company shall have the privilege in making the
said road, or any part thereof, to use oyster shell, rock, or
any other material which will maintain a good road, in all sea-
sons of the year, as to them shall seem most expedient. The
said company shall be and they are hereby authorized to erect
gates across said road, and to charge tolls according to law as
soon as the said road is completed to the eastern si-le of Broad
creek, and on every succeeding mile thereto, as it may be com-
pleted.
4. The said company, in constructing said road, shall have
the control of the entire width, and may, at their discretion,
make it from thirty-five to fifty feet wide.
do. The said company is hereby authoriz2d to receive and
hold land or other species of property, in payment of subscrip-
tions to the capital stock, and to convey and otherwise dispose
of the same: provided, that they shall not, at any one time,
hold more than two thousand acres of land in any one county.
6. This act shall be in force from its passage.
