Chap. 18.—An ACT to Ineorporate the Harrisonburg and Franklin Turn-
pike Company.
Approved December 22, 1870.
1. Be it enacted by the general assembly, That for the pur-
pose of constructing a turnpike road from the town of Har-
risonburg, in the county of Rockingham, through Mount
Clinton to the county line of said county, in the direction of
Franklin, Pendleton county, West Virginia, it shall be lawful
to open books for receiving subscriptions to an amount not
exceeding twenty thousand dollars, to be divided into shares
of twenty-five dollars each. The said books shall be opened
at Mount Clinton, in said county, under the direction of James
C. Ilaltzel, Benjamin D. Bowman, William Burtner, Samuel
Driver, and John F. Long, or any two of them; and at such
other places, and under the direction of such other persons, as
ay two of said commissioners may appoint.
When eighty shares of the capital stock shall have been
subscribed the subscribers, their executors, administrators,
and assions, shall be and are hereby incorporated into a com-
pany by the name and style of The Harrisonburg and Franklin
Turnpike Company, subject to the provisions of the Code of
Virginia, and acts amendatory thereof, in relation to turnpike
companies: provided, that this company shall not be required
to pave or gravel its road, or to make a summer or side road.
That the said road shall be cleared not less than thirty-six feet
wide, and constructed not less than eighteen feet wide, and the
grade shall not exceed five degrees: and provided further,
that the subscribers to the capital stock of said company may
pay their subscriptions either in money or labor on the road,
at such rates and under such regulations as the directors of
the company may adopt. |
3. And be it further enacted, That whenever it shall be
judged expedient by the company, they may construct a branch
of their road, from some convenient point near Harrisonburg,
to Bowman’s mill, in said county.
4, This act shall be in force from its passage.
