Chap. 150.—An ACT for the Relief of the Sureties of James M. Gibson,
late Sheriff of Wise County.
Approved March 18, 1871.
1. Be it enacted by the general assembly, That authority
be given to the auditor of public accounts to suspend collec-
tion of a judgment in the name of the commonwealth against
James M. Gibson, late sheriff of Wise county, John Snodgrass,
Whitley Ramsey, A. J. Long, James Gilley, and Levy Hoback,
his sureties, for a period of twelve months: provided, he shall
be satisfied that the same is sufficiently seeured by judgment
lien; but nothing herein contained shall be construed to pro-
hibit the auditor from collecting the debt whenever he may
think proper to do so.
2. The auditor of public accounts is authorized, and hereby
required, upon a settlement of the aforesaid judgment, to re-
ceive from said sureties payment of the principal, legal interest,
costs, and expenses of collection, abating therefrom the dam-
ages which have been awarded for said default: provided, that
nothing herein contained shall be construed as relieving said
James M. Gibson from the payment of any portion of said
judgment and damages.
3. This act shall be in force from its passage.
