Chap. 74.—An ACT to authorize the State highway commissioner to take road
materials from streams, rivers and water courses, title to the bed of which
is in the Commonwealth, and to prohibit the removal of materials from such
streams, rivers and water courses without permit from the State highway
commission. [H B 62]

1. Be it enacted by the general assembly of Virginia, That the
State highway commissioner be, and he is hereby, authorized to take
tor use on the public roads in this State, sand, gravel, rock, and any
other materials deemed by him suitable for road purposes, from the
streams, rivers and water courses, title to the bed of which is in the
Commonwealth, and in addition to the power of eminent domain al-
ready vested in him, may acquire by condemnation all property, rights
and easements necessary to enable him to obtain and make use of such
materials. All such proceedings shall be governed by the provisions
of law governing the exercise by the State highway commissioner of
the power of eminent domain for State highway purposes.
2. No person, firm or corporation shall take or remove from any
stream, river or water course, title to the bed of which is in the Com-
monwealth, any sand, gravel, rock or other materials suitable for road
purposes without first obtaining a permit in writing from the State
highway commission. Every violation of this section of this act shall
be deemed a misdemeanor and shall be punished as such.
